CC Regular Session <br />Meeting Date: 08/10/2021 <br />By: Bria Raines, Community Development <br />Information <br />5. 8. <br />Title <br />Adopt Resolution #21-183 Approving an Easement Encroachment Agreement for an attached accessory structure in <br />a drainage and utility easement at 16206 Sapphire St NW; Case of William Cowette (Prof. 21-119) <br />Purpose/Background: <br />The City received a Building Permit Application for a deck to be constructed at 16206 Sapphire Street NW (the <br />"Subject Property") on August 15, 2017. The application was discussed and reviewed at the 8/22/2017 <br />Development Review meeting. The application for a 14' deep deck that is 35' in length deck was denied. The <br />property survey contains a "future deck" location outside of the drainage and utility easement (the "Easement"), <br />whereas the application proposed a deck encroaching on the easement.The Property Owner had built the deck <br />without a building permit. Due to the size of the Drainage and Utility Easement, the Property Owner is requesting <br />an Easement Encroachment Agreement for the deck on the rear of the principle structure. <br />This item was brought to the July 27, 2021 City Council meeting, where Council requested a revision to Resolution <br />#21-183 to approve the accessory structure in the Drainage and Utility Easement on the Subject Property. <br />Notification: <br />Notification is not required when considering an Encroachment Agreement. <br />Observations/Alternatives: <br />The Property Owner is applying for an Easement Encroachment Agreement for the deck on the Subject Property. <br />The Property Owner did not apply for a building permit until after -the -fact. City Staff recommend Easement <br />Encroachment Agreement contingent on approval by the City Engineer to ensure the Easement can still function as <br />intended. <br />Funding Source: <br />All costs associated with this request are the Applicant's responsibility. <br />Recommendation: <br />At the July 27, 2021 City Council meeting, members of the Council recommended revision to Resolution #21-183 <br />to approve the Easement Encroachment Agreement to allow a deck to be located within the Easement at 16206 <br />Sapphire Street NW. <br />Action: <br />Motion to adopt Resolution #21-183 approving an Easement Encroachment Agreement for an attached accessory <br />structure in a drainage and utility easement at 16206 Sapphire St NW. <br />Attachments <br />Site Location Map <br />Property Survey <br />
