Board Member introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #05-08- <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE AND DECLARING <br />TERMS OF SAME. <br /> <br /> WHEREAS, Sharp & Associates, LLC (Permit-tee) has properly applied for a variance <br />from the side yard setback requirements in the E-1 Employment District on the property <br />generally known as 6431 140th Court and legally described as follows: <br /> <br />Lot 4, Block 1, Sunfish Gateway Business Park, Anoka County, Minnesota. <br /> <br /> (the "S ubject.Property"); and <br /> <br /> WHEREAS, ~he Board of Adjustment met on August 8, 2005, Conducted the public <br />hearing and adopted findings of fact relating to the request for a variance from the side lot line <br />setback on the north side. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT <br />OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows <br /> <br />Based on Findings of Fact # , a variance to side yard setback requirements is hereby <br />granted for the proposed building. <br /> <br />The proposed building on the Subject Property shall maintain a minimum setback of 9 <br />feet from the side property line (north), <br /> <br />The Permittee shall obtain all necessary permits .prior to commencing any construction.. <br />No bUilding permit shall be issued until the Permittee has signed the variance and <br />reimbursed the City for all costs incurred in processing the application. <br /> <br />The Permittee shall be responsible for all City costs incurred in administering and <br />enforcing this variance. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Board Member <br /> and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />and the following voted against the same: <br /> <br />and the following abstained: <br /> <br />20 <br /> <br /> <br />
