Councilmember <br /> <br />introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #05-08- <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT # RELATING TO A <br />REQUEST FOR A CONDITIONAL USE PERMIT FROM KEITH SCHMIDT TO <br />EXCEED SIZE RESTRICTIONS FOR ACCESSORY BUILDING SPACE ON A <br />PROPERTY BETWEEN 1 AND 1.99 ACRES. <br /> <br /> WHEREAS, Keith Schmidt, hereinafter referred to as the "Applicant", has properly <br />applied for a Conditional Use Permit to exceed the maximum amount of square footage for <br />accessory buildings on properties between I and 1.99 acres as established in section 9.11.02 <br />"Accessory Uses & Buildings" of City Code on the property generally known as 8100 151st Lane <br />NW and legally described as follows: <br /> <br />Lot 4, Block 7, Whispering Pines Estates 2nd, Anoka County, Minnesota <br /> <br />("Subject Property") <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br />RAxMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating <br />to the request are determined to be as follows: <br /> <br />That the Applicant appeared before the Planning Commission for a public hearing pursuant <br />to Section 9.03.05 of the Ramsey City Code on August 8, 2005, and that said public hearing <br />was properly advertised and that the minutes of said public hearing are hereby incorporated <br />by reference. <br /> <br />That the Subject Property is zoned R-1 Residential - Rural Reserve and is located outside the <br />Metropolitan Urban Service Area (MUSA). <br /> <br />That the Subject Property is bordered to the east, west and north by properties also zoned R-1 <br />Residential-Rural Reserve and to the south by a large parcel zoned R-1 Residential MUSA. <br /> <br />That the Subject Property is approximately 1.10 acres in size. <br /> <br />That City Code restricts the Subject Prope.rty to a total of 1,664 square feet of accessory <br />building space. <br /> <br />That there is an existing pole building that is 1,144 square feet and a shed that is 192 square <br />feet on the Subject Property; both would be removed to facilitate the construction of the new <br />accessory building. <br /> <br />That the existing pole building is considered legal non-conforming because the exterior finish <br />consists of metal panels. <br /> <br />110 <br /> <br /> <br />
