Manage~nent Intern Schmidt advised staff is recommending the Council accept the Official Land <br />and Plat Survey shown on the Sketch of Trott Brook Cemetery, completed by Hakanson <br />Anderson and Braun Intertec; authorize staff to declare tots available for burial at the Trott <br />Brook Cemetery; and adopt the Rules and Regulations, Burial Lot Rights Application, and Burial <br />Lot Rights Transfer Application for the Trott Brook Cemetery. <br /> <br />Councilmember Olson thanked staff and the citizens that worked so hard on mapping this <br />important piece of the City's history. <br /> <br />Motion by Councilmember Olson, seconded by Councilmember Jeffrey, to adopt Resolution <br />#05-07-205 Accepting the Official Land and Plat Survey for the Trott Brook Cemetery; to adopt <br />Resolution #05-07-206 Authorizing staff to declare lots available for burial at the Trott Brook <br />Cemetery; and to adopt Resolution #05-07-207 Adopting the Rules and Regulations, Burial Lot <br />Rights Application and Burial Lot Rights Transfer Application for the Trott Brook Cemetery: <br /> <br />Motion carried. Voting Yes: Mayor. Gamec, C°uncilmembers Olson, Jeffrey, Cook, Elvig, and <br />Pearson. Voting No: None. Absent: Councilmember Strommen. <br /> <br />Further discussion: Mayor Gamec directed staff to send a letter to the citizens to thank them for <br />their work on this issue. Councilmember Elvig asked if the cemetery lots will be advertised in <br />lhe Ramscy Resident. Management Intern Schmidt replied a letter will be included in the'Anoka <br />Union regarding the available lots. Assistant City Administrator Nelson indicated there will be <br />an article in the City newsletter as well. <br /> <br />Case #5: <br /> <br />Request for an Appeal to the Board of Adjustment Decision Regarding for a <br />Variance to Density Calculation; Case of Ben Deemer <br /> <br />Community Development Director Trudgeon stated Mr. Ben Deemer is requesting a variance to <br />how thc City calculates maximum density on his parcel located on 14544 Nowthen Blvd (CSAH <br />5). Thc property is located across from Lord of Life Church and is zoned R-2 Medium Density <br />Residential, which allows for up to seven units per net acre. While there is no definition of net <br />density contained specifically in City Code, the definitions section states that minimum lot area <br />is calculated minus road right-of-way. In addition, the Comprehensive Plan and past practice <br />states that net density is calculated as the land area minus, wetland area and major right-of-way. <br />Major right-of-way, for the purposes of density calculations includes State, County, Metropolitan <br />State Aid (MSA) roads. <br /> <br />Community Development Director Trudgeon explained Mr. Deemer's parcel is 1.15 acres <br />(50,510 square feet) in size. The subject property consists of a metes and bounds parcel and <br />Outlot ~); of Wood Pond Hills. However, 0.23 acres (10,178 square feet) of the metes and bounds <br />parcel is subject to a road easement for Nowthen Boulevard (CSAH 5). The applicant owns fee <br />title to the area subject to the road easement and would like to include this area in the density <br />calculations. The applicant has stated that he believes the gross density calculation should be <br />allowed. Staff has raised concerns that perhaps the area subject to the road easement should be <br />excluded l¥om any calculations in order to be consistent with how net density is calculated.
