<br />Councilmember Heineman introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #21-243 <br /> <br />RESOLUTION APPROVING AN EASEMENT ENCROACHMENT AGREEMENT FOR <br />ST <br />AN EAVE OVERHANG ON THE PROPERTY LOCATED AT 8897 151 LANE NW <br /> <br /> WHEREAS, <br />Preserve at Northfork, LLC, hereafter referred to as “Developer”, has <br />requested approval of an easement encroachment up to a one (1) foot into drainage and utility <br />st <br />easements on the property generally known as 8897 151 Lane NW, Ramsey, Minnesota, and <br />legally described as: <br /> <br /> Lot 1, Block 3, Preserve at Northfork, Anoka County, Minnesota <br /> <br /> (the ‘Subject Property’); <br /> <br /> WHEREAS <br />, the City of Ramsey reviewed and approved the easement encroachment <br />agreement on August 24, 2021 subject to City Attorney and City Engineer approval. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1) That the Ramsey City Council hereby approves an Easement Encroachment Agreement <br />authorizing up to a one (1) foot easement encroachment of eave overhangs into the five <br />(5) foot wide, side yard drainage and utility easements on the Subject Property, subject to <br />City Attorney and City Engineer approval and execution of a signed encroachment <br />agreement between Developer and City. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Musgrove, and upon vote being taken thereon, the following voted in favor thereof: <br /> <br /> Mayor Kuzma <br /> Councilmember Heineman <br /> Councilmember Musgrove <br /> Councilmember Howell <br /> Councilmember Riley <br /> Councilmember Specht <br /> Councilmember Woestehoff <br /> <br />and the following voted against the same: <br /> <br /> None <br /> <br />and the following abstained: <br /> <br /> None <br /> <br />
