Councilmember Heineman introduced the following resolution and moved for its adoption: RESOLUTION #21-250 RESOLUTION APPROVING RELEASE OF MULTIPLE AGREEMENTS FOR LOT 2, BLOCK 1, AMSTERDAM EXTENSION RECITALS 1.The City of Ramsey, herein referred to as the “City,” has approved a the Site Plan and Final Plat for an industrial project generally referred to as Oppidan Industrial property known as Lot 1, Block 1, Amsterdam Extension, Anoka County, MN (the “Subject Property”). 2.That the Property Owner, Hageman Holdings, LLC, has a purchase agreement with Oppidan Incorporated for the Subject Property. As part of the closing, the Title Company has requested a release from six (6) documents. 3.The Subject Property is hereby released from the terms and conditions of that certain Development Contract by and between the City and Hageman Holdings, LLC dated May 20, 2011 and filed May 23, 2011 as Document Number 2022343.005 in the Anoka County Recorder’s Office the “Development Contract”). 4.The Subject Property is hereby released from the terms and conditions of that certain Amended and Restated Development Contract by and between the City and Hageman Holdings, LLC dated December 13, 2016 and filed on January 10, 2017 as Document Number 2160375.002 in the Anoka County Recorder’s Office (the “Amended and Restated Development Contract”). 5.The Subject Property is hereby released from the terms and conditions of that certain Assessment Agreement between the City of Ramsey and Hageman Holdings, LLC dated May 20, 2011 and filed May 23, 2011 in the Anoka County Recorder’s Office as Document Number 2022343.006 (the “Assessment Agreement”) 6.The Subject Property is hereby released from the terms and conditions of that certain Amended and Restated Assessment Agreement between the City of Ramsey and Hageman Holdings, LLC dated September 19, 2019 and filed on September 23, 2019 as Document Number 2239308.009 in the Anoka County Recorder’s Office (the “Amended and Restated Assessment Agreement”). 7.The Subject Property is hereby released from the terms and conditions of that certain Development Contract by and between the City and Hageman Holdings, LLC dated May 20, 2011 and filed May 23, 2011 as Document Number 2022343.008 in the Anoka County Recorder’s Office (the “Storm Water Treatment and Ponding Maintenance Agreement”). 8.The Subject Property is hereby released from the terms and conditions of that certain Amended and Restated Development Contract (Partial Release) between the City of Ramsey and Hageman Holdings, LLC dated December 13, 2016 and filed January 10, 2017 as Document Number 2160375.001 in the Anoka County Recorder’s Office (the “Amended and Restated Development Contract (Partial Release)”)
