that 167th Avenue is a pretty fair line at this time to be drawn. They are looking forward to having parking areas at Central Park and Elmcrest Park, and are hoping the City will do a good .job of marking the trails so there are not a lot of complaints from homeowners or the Police l)eparm~cnt of people riding snowmobiles where they should not be. He questioned whether written or oral permission is required to ride snowmobile on someone's property. Mayor Gamec explained the written permission makes it easier for officers checking on any situations. Cotmcilmcmber Cook explained a City can be more stringent than state laws, and the written permission protects the rider as well. He expressed concern with the letter from the Anoka Ramscy Sports Center. He suggested something like a magnetic sticker to indicate that a mechanic is test driving a vehicle. Motion by Councilmember Elvig, seconded by Councilmember Cook, to introduce the ordinance amending City Code with the Recreational Vehicle ordinance. Motion carried. Voting Yes: Mayor Gamec, Councilmembers Elvig, Cook, Jeffrey, Olson, Pearson, and Strommen. Voting No: None. Case/t23: Award Bids for T.H. #47 Pedestrian Underpass Civil I~'.ngineer Il Linton reviewed that the City Council authorized the solicitation of bids for T.It. #47 Pedestrian Underpass June 28, 2005. The bids came in higher than the engineering estimate of $330,000, but the project cost will still be under $400,000. He advised this project will dovetail with the MnDOT project to remove the hump south of 160th Avenue. This project will com~nence after the hump is removed. Staff is recommending awarding the contract for the T.ll. #47 Underpass to Landwehr Construction Inc. in the amount of $352,639.00. Staff also recommcnds the execution of the agreement for the non-motorized recreational trail between the Minnesota Department of Transportation and the City of Ramsey. He advised the City Attorney has raised a point about the term of this contract in that if MnDOT decides to cancel the permit they can remove the trail within 90 days. ('.ounci hnember Elvig questioned if personalized motorized vehicles such as electric wheelchairs would fall under Paragraph 16. Mayor Gamec indicated this would fall under state handicap regulations. City Attorney Goodrich advised staff can make their best efforts to have MnDOT remove the language regarding cancellation of the contract and removal of the trail. Motion by Councilmember Cook, seconded by Councilmember Elvig, to adopt resolution 05-07- 244 awarding bids for T.H. //47 Pedestrian Underpass to Landwehr Construction, Inc. in the amount of $352,639.00, and to authorize execution of the agreement for the non-motorized recreational trail between the Minnesota Department of Transportation and the City of Ramsey.
