This comment letter addresses matters of concern to MPCA staff <br />reviewing the EAW and is submitted for consideration by the City of Ramsay, the responsible <br />governmental unit, in deciding whether an Environmental Impact Statement (EIS) should be <br />prepared on the project. It does not constitute approval by the MPCA ofany or all elements of <br />the project for the purpose of pending or future permit action(s) by the MPCA. We have <br />attempted to identify and consult with interested program staffto id~mtify the MPCA pemfits that <br />may be required. Additional cmnments or requests for information maybe submitted in the <br />future to address specific issues related to the development of such permit(s). Ultimately, it is <br />the responsibility of the project proposer to secure any required permits and to comply with any <br />requisite pemait conditions. <br /> <br />The following comment is made for your use in revising the draft EAW. <br /> <br />Regarding Item 8 of the EAW, a Water Quality Certification will be required for the proposed <br />proiec, t. <br /> <br />Waiver of the Clean Water Act Section 401 Water Quality Certification is required. When <br />wetlands are altered or impacted by either filling, drainage, excavation, or inundation as part of <br />the federal Clean Water Act Section 404 permit process, a statement waiving the 401 <br />Certification ii:om our agency must be obtained. <br /> <br />If you have any qnestions regarding this, please contact Jennifer Olson, of the Regional Division, <br />Business Systems Unit 2, at (651) 297-8611.
