7. <br /> <br />State Building Code Compliance. The Structures shall be constructed in accordance with <br />thc requirements of the Building Code. <br /> <br />Site Plan Compliance. The townhomes and condominium units shall be sited and <br />constructed on the Subject Property in accordance with the Site Plan prepared by Pioneer <br />Engineering dated July 19, 2005. <br /> <br />Fire Lanes. Fire lanes shall be maintained on the Site. The exact locations of these items on <br />the Site shall be as directed by the Fire Chief. The DEVELOPER herein agrees to post "No <br />Parking" signs along private streets in accordance with City Code requirements and in <br />conjunction with the instructions of the Fire Chief. <br /> <br />Buihling Fagade. The DEVELOPER agrees to construct the townhomes and condominium <br />units in accordance with the site plan prepared by Pioneer Engineering, colored elevations <br />provided by Brightkeys, and approved by the City Council on April 12, 2005. The units will <br />consist of brick, maintenance free siding, colored accents, and asphalt shingles. Revised <br />building elevations must be submitted for review and approval to the CITY for the units that <br />ti-om on Bunker Lake Blvd., prior to the release of building permits for these units. <br /> <br />Stage [ Improvements Required. The improvements the CITY requires the <br />DEVELOPER to construct within the Plat are as follows: <br /> <br />Trunk and lateral sanitary sewer system <br />Trunk and lateral watermains and appurtenances <br />Streets with concrete curb and gutter <br />Trunk and lateral storm drainage facilities <br />Trail Construction along Ramsey Blvd. N.W. and 149th Ave NW <br />Sidewalk Construction along all public streets within the Plat as shown in the <br />final plans. <br />Natural gas <br />Telephone service <br />Electric service <br />Street lights (installment arranged by CITY during Stage I Improvements and <br />paid for by DEVELOPER as Stage II Improvement) <br />Installation of bituminous driveways, driveway collectors, parking nodes and <br />maneuvering areas. <br />Installation of continuous, surmountable concrete curbing and gutter around the <br />perimeter of all bituminous surfaces, except residential driveways and trails. <br />Establishment of turf in areas disturbed during construction and in accordance <br />with the Site Plan. <br />Landscaping in accordance with the Landscape Plan prepared by Hoisington <br />Koegler Group, Inc., dated February 8, 2005, revised March 21, 2005. <br />Irrigation metering and backflow devices shall be approved as part of the Utility <br />Plan, and installed accordingly. <br /> <br />Town Center Gardens 3ra Addition <br />Development Agreement <br /> Page 3 of 12 <br /> <br /> <br />
