Background: <br /> <br />REQUEST FOR VACATION OF EASEMENTS IN <br />TOWN CENTER GARDENS 3m) ADDITION; <br />CASE OF BRIGHTKEYS, INC. <br /> By: Amy Geisler, AICP, Associate Planner <br /> <br />The City Council approved the preliminary plat of Town Center Gardens 3rd Addition on April <br />12, 20(/5 and is considering final plat approval on this agenda. The 3~d Addition is a re-plat of <br />portions of the 1st and 2'~d Additions of Town Center Gardens, which included the standard <br />drainage and utility easements. These easements must now be vacated to allow for the recording <br />of Town Center Gardens 3rd Addition, which includes new drainage and utility easements. <br /> <br />Thc following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br />c) <br /> <br />Notification: <br /> <br />Site location map <br />Exhibits of underlying easements to be vacated <br />City Council meeting minutes dated June 28, 2005 <br />Proposed ordinance <br /> <br />In accordance with State Statute, City Staff attempted to notify property oWners within 350 feet <br />of thc subject property of the public hearing to vacate easements. <br /> <br />Obserw~tions: <br /> <br />rt takes a public hearing and Council ordinance to eliminate the underlying drainage and utility <br />easements that exist as part of Town Center Gardens 1st and 2nd Additions. The public hearing <br />was held on June 28, 2005; the ordinance is now ready for adoption. <br /> <br />Recommendation: <br /> <br />City Staff' recommends adoption of the enclosed ordinance to vacate existing easements. <br /> <br />Council Action: <br /> <br />Motion to adopt Ordinance #05-__ to vacate certain drainage and utility easements in Town <br />Center Gardens 3~d Addition. <br /> <br />Review Checklist: <br /> <br />City Engineer <br />Community Development Director <br /> <br />CC: I}8/09/05 <br /> <br /> <br />
