City staff has also had contact With Jay and Cindy Pugh who <br />live at 5518 144th Court. City staff has visited the site several times and has met with the homeowners and <br />a representative of Shade Tree Construction regarding tb2s &ainage issue. Staff.has also researched the <br />documents on file at the city regarding this project. <br /> <br />History <br /> <br />The city has on file an approved ~ading plan and a ~ading as-built plan.for 'this development. A tree <br />preservation ordinance was enacted during ~ading of this project and several sig-nificant trees were <br />preserved on the site, including trees on near the back lines of lots 23 and 24. The base of the trees on lot <br />24 are 2 feet lower than plan ~ades while the trees on lot 23 are 3 feet higlqer than plan ~ades. A rock <br />retaining wall was constructed around the trees on lot 23. This wall encompasses a section of the <br />drainage and utility easement. The eastern portion of lot 23 and the western portion of lot 24 drain to the <br />]o~x, area around the trees on lot 24. Copies of this area of the ~ading plan, as-built ~ading plan and <br />certificates of survey for lots 23 and 24 are enclosed for reference. <br /> <br /> <br />
