Assistant Public Works Director Olson indicated staff received a new draft dated June 10, 2005. Thc tcnn of the contract is 15 years; at the time it goes beyond 15 years it will revert back to all sewer and water trunk fees coming back to the City. Anything beyond the defined area would not be covered in the contract. He advised there are some additional lots Oakwood Land l)evclopmcnt has agreed to pay for that will not necessarily go through final platting to the west of thc cxisting preliminary plat; these lots are referred to as future sub-dividable lots. There is also language included that would allow for collection on the John Roe property, which was included in the request for the feasibility study. City Administrator Norman indicated if the Council determines the agreement is ready for attthorization it will be placed on the agenda of the next Council meeting. John Pcterson of Oakwood Land Development stated July 20th is the end of the comment period for thc I';AW for Brookfield. He expects to be in front of the Planning Commission in August for prcliminary plat, and this is a crucial time to formalize this agreement. Councihncmber Cook stated it is important for the City to have this agreement, as it shows how equitable the agreement is and what the City has to gain from it. Councihncmber Elvig stressed the importance of informing the public that this six million dollars from Oakwood Land Development is going towards both sewer and water development. 'l'he consensus of the Council was to direct that the City Attorney and the attorney representing Oakwood Land Development to put the proposed draft into a contract, and to direct staff to place thc contract on the agenda of the next City Council meeting. 2) Bid Alternates for the Municipal Center Parking Garage Reprcscntatives of LSA Design reviewed with the Council the following bid alternates for the Municipal Center Parking Garage, and advised the prices will be held for 30 days: I. Real stone element on the lowest five feet of the building at a cost of $140,000 in addition to the ha,ye hid. Thc consensus of the Council was not to proceed with this bid alternate. 2. Sled curtain wall ,system as opposed to the base bid of an aluminum curtain wall system in the pedestrian stair area of the parking facility at a cost of $170, 000 in addition to the base bid Assistant Public Works Director Olson advised the aluminum curtain wall system was bid on the Municipal Center south wall.
