Councilmember introduced the following resolution and moved for its adoption: <br />RESOLUTION #21-243 <br />RESOLUTION APPROVING AN EASEMENT ENCROACHMENT AGREEMENT FOR AN EAVE <br />OVERHANG ON THE PROPERTY LOCATED AT 8897 151ST LANE NW <br />WHEREAS, Preserve at Northfork, LLC, hereafter referred to as "Developer", has requested approval <br />of an easement encroachment up to a one (1) foot into drainage and utility easements on the property generally <br />known as 8897 151st Lane NW, Ramsey, Minnesota, and legally described as: <br />Lot 1, Block 3, Preserve at Northfork, Anoka County, Minnesota <br />(the `Subject Property'); <br />WHEREAS, the City of Ramsey reviewed and approved the easement encroachment agreement on <br />August 24, 2021 subject to City Attorney and City Engineer approval. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, <br />ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. That the Ramsey City Council hereby approves an Easement Encroachment Agreement authorizing up to <br />a one (1) foot easement encroachment of eave overhangs into the five (5) foot wide, side yard drainage <br />and utility easements on the Subject Property, subject to City Attorney and City Engineer approval and <br />execution of a signed encroachment agreement between Developer and City. <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember , and <br />upon vote being taken thereon, the following voted in favor thereof: <br />and the following voted against the same: <br />and the following abstained: <br />and the following were absent: <br />whereupon said resolution was declared duly passed and adopted by the Ramsey City Council this 24th day of <br />August, 2021. <br />Mayor <br />ATTEST: <br />City Clerk <br />
