Carrie Mahowald, 5541 145th Circle stated she lives behind the property in question. She <br />indicated if' the City continues to change or make variances to the rules it has set up, it affects <br />everyone down the road. She commented that as a homeowner she would not ask for a variance <br />lbr her home. She stated developers make money, or they would not be in the business, and she <br />asked thc I'lanning Commission to consider the neighboring properties. She indicated approving <br />this variance will have an affect on traffic in the area. She stated she turns on 142nd and people <br />pass her on the shoulder, and she saw someone almost get hit because a car was passing on the <br />shoulder. She indicated there is a lot of high school traffic in the morning, and she thinks the city <br />needs to bc very thoughtful when considering this or any variance. <br /> <br />Mike l~erry, 14571 Ilelium Court, stated he is also behind this property. He indicated he has the <br />same concerns with people turning, and noted the turn for this development would be within 100 <br />yards of 146th Street, and also by the turn for the church. He stated this is too much activity in a <br />close distance. He indicated there are already a lot of people in the area and cars do drive on the <br />shoulder. Itc stated he is also concerned about trees that now provide screening for his home. <br />I Ic indicated he and his wife knew it was zoned for up to six units when they purchased their <br />home, and while they were not happy about that they could live with it, but he does not think <br />there should be any more than that. He added that before he bought his home he talked to <br />someone at the City who said a big problem would be the turn-off for this development, and they <br />thcmght the land owner would have to buy the next property also in order to make a development <br />work, so hc was not too concerned. <br /> <br />Mr. i'crry stated the trees do provide a nice screening now, and if they were removed during <br />construction he would have to look at six units. <br /> <br />Board Member Brauer noted that if the Board of Adjustments denies this variance, Mr. Deemer <br />could still construct six units. <br /> <br />Mr. l'crry indicated he understood. <br /> <br />Jcssica t'crry, 14571 Helium Court, asked if there was a requirement for any separation between <br />singlc-lhmily homes and this type of home. She also wondered if there is a height restriction, as <br />she is concerned about decks looking into her back yard. <br /> <br />Assistant Community Development Director Frolik indicated there would be density <br />transitioning, and is a height restriction, but it is 35 feet. <br /> <br />iMf. l)crry noted that the trees he was mentioning are 50 feet now, so they would still provide <br />screening. <br /> <br />Board Member Brauer stated it would be in the developer's interest to save those trees, as they <br />can bc used toward the landscaping requirements and density transitioning. <br /> <br />Board of Adjustment/June 23, 2005 <br /> Page 4 of 8 <br /> <br /> <br />
