CC Regular Session 7, 7, Meeting Date: 09/28/2021 By: Colleen Lasher, Administrative Services Information Title Contract for Civil Legal Services with the firm of Holstad & Knaak, PLC. Purpose/Background: At the Council work session of September 14, 2021, it was the consensus of the Council to prepare a contract for civil legal services with the firm of Holstad & Knaak, PLC, with Frederick W. Knaak, Esq. to serve as the City Attorney, for Council consideration at the regular meeting of September 28, 2021. Attached is a copy of the proposed contract recommended by staff. The contract has been reviewed by staff, by Mr. Knaak, and by the City's prosecuting attorney. In general, the proposed contract is consistent with the proposal submitted by the firm and as presented to the council previously. An effective date of November 1, 2021 is recommended. This will coincide with the termination of our current legal services contract and the thirty (30) day notice provision of our existing contract. Observations/Alternatives: Council may opt to approve the contract for civil legal services as presented, adopt the language changes recommended by staff, or modify based upon discussion. The contract is written for two years and has a sixty-day written termination provision for either party. Funding Source: General legal services are paid through the City's General Fund. In this contract, third -party billings may reimburse the City for the cost of the retainer. Recommendation: Staff is recommending approval of the attached contract for civil legal services. Action: Motion to authorize the City Administrator to enter into a contract for legal services with the firm of Holstad & Knaak, with Frederick W.
