Commissioner Walker introduced the following resolution and moved for its adoption: <br />RESOLUTION #21-253 <br />A RESOLUTION GRANTING THE ISSUANCE OF A VARIANCE TO FENCE <br />HEIGHT AT THE PROPERTY AT 15337 NOWTHEN BLVD NW <br />RECITALS <br />1. Kristina Myhers, hereinafter referred to as the "Applicant", has properly applied for <br />a Variance to exceed the height restriction in the front yard for a fence (the "Fence") <br />on the property located at 15337 Nowthen Blvd NW and legally described in Exhibit <br />A. <br />2. That the Subject Property is zoned R-1 Residential (MUSA) District; the <br />surrounding parcels are also zoned R-1 Residential (MUSA). <br />3. That the Subject Property is approximately 4.17 acres in size. <br />4. That the proposed Fence would be six (6) feet tall consisting of treated framing <br />materials with 6" x 6" maintenance free posts and 1' x 4' cement boards. <br />5. A Variance is required to exceed the height restriction for fences placed in the front <br />yard of residential properties. <br />6. That City Staff noted the proposed fence height in the front yard for permit <br />RA048649 and contacted the Applicant about a Variance. <br />7. That the Planning Commission met and held a duly noticed public hearing on <br />September 23, 2021. <br />FINDINGS OF FACT <br />1. That the proposed use will not adversely impact traffic in the area. <br />2. That the proposed use will not substantially or adversely impair the use, enjoyment <br />or market value of surrounding properties. <br />3. That the proposed use will be constructed so as to be harmonious and appropriate in <br />appearance with the existing or intended character of the general vicinity and such <br />use will not change the essential character of the area. <br />4. That the proposed use will not create additional requirements at public cost for public <br />facilities and services. <br />
