CC Regular Session 7, 5, <br />Meeting Date: 09/14/2021 <br />By: Chris Anderson, Community <br />Development <br />Information <br />Title <br />Adopt Resolution #21-260 Granting Approval of Final Plat and Development Agreement for Williams Woods <br />(Project No. 20-138); Case of Bill Boyum <br />Purpose/Background: <br />The purpose of this case is to consider approval of the Final Plat and Development Agreement for a nine (9) lot <br />subdivision known as Williams Woods. The plat includes six (6) total parcels all affiliated with 7363 175th Avenue <br />NW (the "Subject Property"). The City Council approved the Preliminary Plat on June 22, 2021 and the Final Plat <br />is generally consistent with the approved Preliminary Plat. The Planning Commission has approved a variance to <br />cul-de-sac length for the project as well as a variance to wetland setbacks for several lots (Lots 3-5). <br />Notification: <br />The City attempted to notify Property Owners, as reflected in the Anoka County Property Records, within 700 feet <br />of the Subject Property of the Public Hearing held by the Planning Commission on June 3, 2021 (for Preliminary <br />Plat; there is no Public Hearing requirement for Final Plat consideration). The Public Hearing notice was also <br />posted in the City's Official Newspaper, the Anoka County UnionHerald. No additional notification was provided, <br />or is required, for this meeting. <br />Observations/Alternatives: <br />The plat will create nine (9) new single family residential lots accessed by a public cul-de-sac off of 175th Avenue. <br />Lots will range in size from approximately 3.5 acres up to about 22 acres. All lots comply with the bulk standards of <br />the R-1 Residential (Rural Developing) District. <br />As the City Council may recall, the owner of an adjacent, landlocked parcel, had requested a 60-foot wide access be <br />provided from the new public street to his land. However, the approval of the Preliminary Plat was not contingent <br />upon inclusion of the requested access. Subsequently, that property owner has submitted a formal petition for the <br />City to grant a cartway to access his land. MN State Statutes outline the procedure for processing such a petition. <br />The City Attorney has confirmed that since the access was not a contingency of approval of the Preliminary Plat, it <br />cannot be a requirement of the Final Plat. A separate case is on the agenda this evening to specifically address the <br />cartway petition. <br />Alternatives <br />Alternative 1: Approve the Final Plat and Development Agreement for Williams Woods. The Final Plat is generally <br />consistent with the approved Preliminary Plat. The project is consistent with the zoning designation (R-1 <br />Residential Rural Developing), with the Future Land Use Map designation (Rural Developing), and appears to <br />minimize impacts to natural resources on site. Staff supports this alternative. <br />Alternative 2: Do not approve the Final Plat. As noted, the Final Plat is generally consistent with the Preliminary <br />Plat, which City Council previously approved earlier this summer.
