<br />Councilmember Woestehoff introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #21-261 <br /> <br />RESOLUTION APPROVING AMENDMENT NO. 2 TO DEVELOPMENT AGREEMENT <br />FOR COR SAPPHIRE ADDITION <br /> <br />WHEREAS, on October 7, 2019, a Development Agreement for COR Sapphire Addition <br />was executed between the City of Ramsey and Sapphire Apartment, LLC; and <br /> <br />WHEREAS, the COR Sapphire Addition abuts the segment of Center Street that was <br />constructed as a temporary pavement section without pedestrian facilities; and <br /> <br />WHEREAS, the approved development plans did not address public improvements along <br />Center Street within the City’s right-of-way, and instead only required the developer to construct <br />a retaining wall, a concrete cross gutter between Center Street and their private driveway, and to <br />establish turf within City right-of-way; and <br /> <br />WHEREAS, the City intended to develop plans to construct public improvements along <br />Center Street following development and approval of the Center Street Area Framework and <br />Policy Plan as an update to The COR Design Guidelines and Framework; and <br /> <br />WHEREAS, following approval of the Center Street Area Framework and Policy Plan on <br />March 23, 2021, the City developed final plans for constructing the required private and public <br />improvements along Center Street; and <br /> <br />WHEREAS, to facilitate the most cost-effective and timely construction of the required <br />private and public improvements, Amendment No. 1 to the Development Agreement for COR <br />Sapphire Addition was developed; and <br /> <br />WHEREAS, based on estimated costs from the final plans, the City will be responsible for <br />a not-to-exceed cost of $141,740.15 and the developer will be responsible for a not-to-exceed cost <br />of $12,410.85 as outlined in Amendment No. 1; and <br /> <br />WHEREAS, pursuant to adoption of Resolution 21-221 on July 27, 2021, Amendment <br />No. 1 was approved by the Ramsey City Council; and <br /> <br /> WHEREAS, Amendment No. 2 is presented to the Ramsey City Council for approval. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1) That the Ramsey City Council hereby approves Amendment No. 2 to the Development <br />Agreement for COR Sapphire Addition. <br /> <br />2) That the Mayor and City Administrator are hereby directed to execute Amendment No. 2 to <br />the Development Agreement for COR Sapphire Addition. <br /> <br />
