CC Regular Session 5.9. <br />Meeting Date: 11/09/2021 <br />By: Brian McCann, Community <br />Development <br />Information <br />Title <br />Adopt Resolution #21-288 Granting a Conditional Use Permit for Auto Sales at 6740 Highway 10 NW and <br />Declaring Terms of Agreement <br />Purpose/Background: <br />The purpose of this case is to consider a request from Sang Huynh and Toan Danh (the "Applicants") for a <br />Conditional Use Permit (CUP) for commercial auto sales as well as outdoor storage of vehicles, trucks, and trailers <br />attendant to this business located at 6740 Highway 10 NW (the "Subject Property"). The Applicant is proposing <br />operation hours of 8:00 a.m. to 5:00 p.m. Monday though Friday, 8:00 a.m. to noon on Saturday, and being closed <br />on Sundays. The property is zoned B-2 Highway Business District and is guided for Commercial in the <br />comprehensive plan. Motor vehicle, implement, and recreation equipment sales and service are allowed as a <br />Conditional Use in the B-2 District. The Applicants are proposing two motor vehicle dealers operating from this <br />location. <br />Notification: <br />Staff attempted to notify all property owners within 350 feet of the Subject Property of the requested Conditional <br />Use Permit via standard U.S. mail and published the Notice of Public Hearing in the Anoka County UnionHerald. <br />Observations/Alternatives: <br />Summary <br />In addition to auto sales, the Applicants are proposing to fully enclose the Subject Property with a privacy fence to <br />ensure security and a presentable view from Highway 10. Another proposed change to the Subject Property is an <br />expansion to the property's parking lot. The expansion is proposed for the southwestern portion of the property and <br />will connect existing bituminous pavement up to the property line. The proposed expansion will add approximately <br />6,000 square feet of impervious surface to the Subject Property. <br />They anticipate the number of vehicles on site to fluctuate based on business volume and number of customers. <br />They plan for the average number of vehicles to be consistent with approximately 80% of the total number of <br />marked parking stalls that the Applicant intents to paint, with adequate allowance for movement of the vehicles as <br />well as for traffic generated by customers and staff. This will not include building areas and customer/staff parking. <br />An onsite inspection of the Subject Property was made on October 7, 2021 with Planning Staff and the Building <br />Official. The inspection revealed non -compliant ADA bathrooms, no striping for costumer parking and only <br />enough office space for a single automotive salesperson. There was brief discussion into the feasibility of the <br />Applicant's desire to convert some of the mini storage units into an automotive repair facility, but the Applicants are <br />no longer pursuing that and it was not deemed feasible by the Building Official. <br />October Planning Commission <br />At their regular meeting on October 28th, 2021, the Planning Commission recommended adoption of Resolution <br />#21-288 Granting a Conditional Use Permit for Auto Sales at 6740 Highway 10 NW and Declaring Terms of <br />Agreement. <br />Alternatives <br />Alternative 1: Motion to approve the CUP with conditions as proposed by City Staff.
