<br />No Resolution – Withdrawn. <br /> <br />Councilmember introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #21-133 <br /> <br />A RESOLUTION AUTHORIZING ABATEMENT AND <br />CODE ENFORCEMENT PROCESS FOR 6225 RIVLYN AVE NW <br /> <br />RECITALS <br /> <br />1. The property owners John and Jessica Kidd (the “Property Owner”) has an open code <br />enforcement case on the property generally known as 6237 Rivlyn Avenue NW and legally <br />described as follows: <br /> <br />AUDITORS SUB NO 96 LOT 26, AUD SUB 96-TH PT OF LOT 26 DES AS FOL- <br />COM AT A PT WHERETHE ELY LINE OF POPLAR DRIVE INTERSECTS WITH <br />THE NLY LINE OF RIVLYN ROAD-TH ELY ALONG THE NORTHERN LINE OF <br />RIVLYN ROA D A DISTOF 100 FT-TH NLY & PARA TO THE ELY LINE OF <br />POPLAR DRIVE A DIST OF 110 FT-TH WLY A DIST OF 100 FT MORE OR LESS <br />TO A PT ON THE ELY LINE OF POPLAR DRIVE WHICH PT IS 110 FT NLY FROM <br />PLACE OF COM-TH SLY 110 FT MORE OR LESS TO PT OF COM-SD ROADS <br />BEING AC- CORDING TO PLAT OF DICKENSONS MISS ESTATE, Anoka County, <br />MN (the “Subject Property”); and <br /> <br />2. The Subject Property is zoned R-1 MUSA and is approximately 0.25 acres in size; and <br /> <br />3. The City has most recently opened a case on the Subject Property for violations related to <br />off-street parking (recreational items and vehicles parked on grass), and public nuisance <br />items (pile of items outside garage); and <br /> <br />4. The Nuisance Regulations in the City Code (Chapter 30) prohibit the outdoor storage of junk, <br />debris, items that are not being put to their intended use, construction debris, and other <br />stockpiles of materials; and <br /> <br />5. City Code Section 117-355 prohibits more than 6 items on the Subject Property, prohibits <br />vehicles stored on the grass, and outlines allowable parking on the Subject Property; and <br /> <br />6. Actions to date include: <br />a. April 16, 2021 – First inspection from road and first notice of violation sent via US <br />Mail <br />b. May 3, 2021 – Spoke to owner, John Kidd, who requested 2 week extension as no <br />one is living on the property. <br />c. May 4, 2021 – Received voicemail that owner is repairing roof and needs more time <br />to clean up as materials will be onsite. Extension granted. <br />i. Reinspection scheduled for May 14, 2021 with owner, John Kidd. <br /> <br />7. The City Council authorized the abatement of the property following the proposed processed <br />outlined below. <br /> <br /> <br />
