CASE # <br /> <br />REQUEST FOR A CONDITIONAL USE PERMIT FOR <br />AN OVERSIZED ACCESSORY BUILDING; <br /> CASE OF KEITH SCHMIDT <br /> By: Chris Anderson, Zoning & Recycling Coordinator <br /> <br />Background: <br /> <br />rI'l~e City has received an application from Keith Schmidt for a conditional use permit to exceed <br />thc maximum allowable square footage for accessory buildings on. properties between 1 and 1.99 <br />acres as established in City Code on the property located at 8100 151st Lane NW. <br /> <br />The following items are enclosed for your information: <br /> <br />a) Site location map <br />b) Site layout <br />c) Site picture <br />d) Proposed findings of fact <br />e) Proposed conditional use permit <br /> <br />Notification: <br /> <br />State statute requires notification of the public hearing to property owners within 350 feet of the <br />subject property. Staff' selat out notices to all property owners within 350 feet. <br /> <br />Obscrwttions: <br /> <br />Thc subject property is approximately 1.10 acres (47,'~42 square feet) in size and is located <br />outside thc Metropolitan Urban Service Area (MUSA). According to City Code, the property is <br />eligible fbr 1,664 square feet of accessory building space. <br /> <br />q'hc proposed building would be 1,760 square feet (44' x 40') in size. Combined with the <br />existing attached garage (484 sq. ft.), the applicant would have 2,244 sq. ft. in accessory building <br />space. This results in an overage of 580 square feet. The applicant would like to exceed the size <br />restriction in order to construct a detached accessory .building that would accommodate the <br />storage o {~ private use vehicles and equipment. <br /> <br />There is an existing pole building (26' x 44') and shed (12' x 16') on the property, both of which <br />would bc removed to facilitate the construction of the new building. The exterior finish of the <br />existing pole building consists of metal paneling and thus is considered legal non-conforming. <br />Thc proposed building would be located in place of the existing pole building, which is in the <br />rear yard, and will exceed all setbacks established in the R-1 Rural Reserve District. The exterior <br />tinish o[' the proposed building will match that of the home (vinyl siding) and the building would <br />not exceed the sixteen (16) fbot mean gable r°ofheight restriction. <br /> <br /> <br />
