CASE # CONSIDERATION OF AN AMENDMENT TO THE 2005 SCHEDULE OF RATES, FEES, AND CHARGES REGARDING SEWER AND WATER TRUNK FEES FOR PLATS RECORDED IN 2004 By: Patrick Trudgeon, AICP, Community Development Director Back~4round: On January 25, 2005, the City Council adopted an ordinance that amended the 2005 Schedule of Rates, Fees, and Charges to provide that for all lots within plats recorded with Anoka County in 2004 be charged the 2004 Sewer and Water Trunk Fee rate. The 2005 water and sewer trunk fees were raised significantly as a resull of the completed Sewer and Water Comprehensive Plan. An error occurred within the proposed ordinance that listed the 2005 sewer and water trunk rat~es instead el' the 2004 rates. The adopted ordinance had the sewer trunk fee as $1,100 per unit instead of $596.00 and thc water trunk f~e was listed as $1862 per unit instead of $1,327.00. The lower amount should have been inserted into the ordinance. The following items are attached for your information: a) Case Cover Sheet dated January 25, 2005 b) Approved Ordinance 05-02 c) Approved City Council Minutes dated January 25, 2005 d) Proposed Ordinance Reco~nmendation: Thc City Attorney has advised Staff that the original ordinance should be rescinded and that a new ordinance be adopted. To that end, Staff is recommending that the City Council rescind Ordinance 05-02 and introduce a new ordinance with the proper 2004 rates. Council Action: Motion to rescind Ordinance 05-02, regarding sewer and water trunk fees charged for plats recorded in 2O04. ~and- Motion to introduce Ordinance #05-XX to amend the 2005 Schedule of Rates, Fees, and Charges in order to collect scwer and water trunk hook-up charges at the 2004 rate for plats recorded in 2004.
