Case #7: <br /> <br />Introduction of an Ordinance Authorizing the Sale of Lots 2, Block 1, <br />Sunfish Lake Business Park, Anoka County, Minnesota <br /> <br />City Attorney Goodrich explained the City is negotiating a TIF agreement with Harber <br />Industries. As part of the transaction, the City is to convey title to Lot 2, Block 1, Sunfish Lake <br />Business Park to Harber Industries. In order to complete this .transaction a sale ordinance needs <br />to be introduced and adopted authorizing the sale. <br /> <br />Motion by Councilmember Jeffrey, seconded by Councilmember Olson, to introduce an <br />ordinance authorizing the sale of Lot 1, Block 1, Sunfish Lake Business Park. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Jeffrey, Olson, Cook, Elvig, <br />Pearson, and Strommen. Voting No: None. <br /> <br />Case #8: <br /> <br />Request for an Interim Use Permit to Operate a Graphics Equipment and <br />Supplies Business in a Detached Accessory Building; Case of Paul & <br />Catherine Sills <br /> <br />Assistant Community Development Director/Executive HRA Director Frolik explained the City <br />has received an application from Paul & Catherine Sills, who reside at 8751 162nd Lane NW, <br />requesting an Interim Use Permit to operate a graphics equipment and supplies business in a <br />detached accessory building on their residential property. Mr. and Mrs. Sills currently operate a <br />graphics equipment and supplies business in a detached accessory building on their residential <br />property. They employ one non-resident, part time administrative employee to .assist with their <br />business. The Sills' pa/rcel is roughly .1.5 acres in size and therefore, they are not eligible to <br />apply for an Accessory Structure Home Occupation Permit. In light of this, they have applied <br />for an Interim Use Permit to allow their business operation to continue. <br /> <br />Ms. Frolik indicated the Sills' business is conducted almost entirely by computer, phone, and <br />deliveries. Roughly. 90% of all orders are shipped from the Sills' suppliers directly to their <br />customers' locations. The remaining '10% of the orders are delivered to and shipped from their <br />residential property by ground services'such as UPS, FedEx, or SpeeDee. Customers rarely visit <br />their location, but when they do, it is by appointment only, While the application is for an <br />Interim Use Permit, the standards for an Accessory Structure Home Occupation Permit are being <br />used to evaluate this request. The number of vehicle trips would be well within the home <br />occupation ordinance ~m~idelines. The Planning Commission conducted a public hearing and <br />reviewed the request for an interim use permit on July 7, 2005, and recommended approval of <br />the request with one stipulation, that the permit be approved irdtially for one year and include <br />four successive, automatic one-year renewals provided that there are no outstanding permit <br />violations on record at that time. <br /> <br />Motion by Councilmember Cook, seconded by Councilmember Jeffrey, to adopt Resolution #05- <br />07-232 adopting Findings of Fact #0730 relating to Paul & Catherine Sills' request for an interim <br />use permit. <br /> <br />P40 <br /> <br />City Council / July 26, 2005 <br /> Page- 14 of 35 <br /> <br /> <br />
