that 167th Avenue is a pretty fair line at this time to be drawn. They are looking forward to <br />having parking areas at Central Park and Elmcrest Park, and are hoping the City will do a good <br />.job of marking the trails so there are not a lot of complaints from homeowners or the Police <br />Department of people riding snowmobiles where they should not be. He questioned whether <br />written or oral permission is required to ride snowmobile on someone's property. <br /> <br />Mayor Gamec explained the written permission makes it easier 'for officers checking on any <br />situations. <br /> <br />Councihnember Cook explained a City can be more stringent than state laws, and the written <br />permission protects the rider as well. He expressed concern with the letter from the baaoka <br />Ramsey Sports Center. He suggested something like a magnetic sticker to indicate that a <br />mechanic is test driving a vehicle. <br /> <br />Motion by Councihnember Elvig, seconded by Councilmember Cook, to introduce the ordinance <br />amending City Code with the Recreational Vehicle ordinance. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Elvig, Cook, Jeffrey, Olson, <br />Pearson, and Strommen. Voting No: None. <br /> <br />Case #23: Award Bids for T.H. #47 Pedestrian Underpass <br /> <br />Civil Engineer II Linton reviewed that the City Council authorized the solicitation of bids for <br />T.I:f. #-47 Pedestrian Underpass June 28, 2005. The bids came in higher than the engineering <br /> but the cost <br />estimate o'f $330,000, /. project will still be under $400,000. He advised this project <br />will dovetail with the MnDOT project to remove the hump south of 160th Avenue. This project <br />will commence after the hump is removed. Staff is recommending awarding the contract for the <br />T.H. fl47 Underpass to Landwehr Construction Inc. in the amount of $352,639.00. Staff also <br />recommends the execution of the agreement for the non-motorized ~:ecreational trail between the <br />Minnesota Department of Transportation and the City of Ramsey. He advised the City Attorney <br />has raised a point about the term of this contract in that if MnDOT decides to cancel the permit <br />they can remove the trail within 90 days. <br /> <br />Councilmember Elvig questioned if personalized motorized vehicles such as electric wheelchairs <br />would fall under Paragraph 16. <br /> <br />Mayor Gamec indicated this would fall under state handicap regulations. <br /> <br />City Attorney Goodrich advised staff can make their best efforts to have MnDOT remove the <br />language regarding cancellation of the contract and removal of the trail. <br /> <br />Motion by Councilmember Cook, seconded by Councilmember Elvig, to adopt resolution 05-07- <br />244 awarding bids for T.H. #47 Pedestrian Underpass to Landwehr Construction, Inc. in 'the <br />amount of $352,639.00, and to authorize execution of the agreement for the non-motorized <br />recreational trail between the Minnesota Department of Transportation and the City of Ramsey. <br /> <br />City Council / July 26, 2005 <br /> Page 33 of 35 <br /> <br />P59 <br /> <br /> <br />
