Councilmember X~XXXXXXXXXX introduced the following resolutiOn and moved for its <br />adoption: <br /> <br />RESOLUTION # <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT <br />TO EXCEED ACCESSORY BUILDING SQUARE FOOTAGE RESTRICTIONS AT 7960' <br />171~t LANE NW BASED ON FINDINGS OF FACT AND DECLARING TERMS OF <br />SAME: <br /> <br /> WHEREAS, David and Lynette Randall (Permittee) have properly applied for a <br />conditional use permit to exceed the detached accessory building square footage restrictions <br />established in section 9.11.02 "Accessory Uses" of City Code on the property generally known as <br />7960 171st Lane NW and legally described as follows: <br /> <br />Lot 3, Block 1, Dellwood Hills <br />(Subject Property) <br /> <br /> WHEREAS, the Planning Commission met on September 1st, 2005, conducted <br />the public hearing and recommended City Council approval of the request. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THIS cITy COUNCIL OF THE <br />CiTY OF RAiVISEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />Bast:d on Findings oCFact #XXXX, a conditional use permit (Permit) to exceed the detached <br />accessory building square footage restriction for said property as established in City Code, is <br />hereby granted to David and Lynette Randall, hereinafter referred to as the "Permittee" <br /> <br />That tile new accessory building shall not exceed 1,200 square feet and the total accessory <br />building space on the s.ubject property shall not exceed 2,480 squaye feet. <br /> <br />That the construction of the detached accessory building on the Subject Property shall require <br />issuance of a building permit from the City of Ramsey. <br /> <br />That the accessory building shall be properly constructed and maintained in accordance with <br />all applicable Uniform Building Codes and local zoning regulations. <br /> <br />The Permittees herein agrees that no business use will be operated in the detached accessory <br />building unless such use is permitted in accordance with the City Code. <br /> <br />That this Permit shall be perpetual in duration as long as the terms are herein complied'with. <br /> <br />That the Permittee shall be responsible for all City costs incurred in administering and- <br />enfi>rcing this Permit. <br /> <br />'['hat tile City Administrator, or his/her-designee, shall have the right to inspect the premises <br />1'o,' compliance and safety purposes annually or at any time, upon reasonable request. <br /> <br /> <br />
