CASE # 3 <br /> <br /> PUBLIC HEARING <br />REQUEST FOR A CONDITIONAL USE PERMIT TO <br />CONSTRUCT AN ACCESSORY STRUCTURE FOR A LEGAL, <br />NON-CONFORMING USE <br /> By: Breanne Dairies, Associate Planner <br /> <br />Background: <br /> <br />The City received an application from George and Frances Cowles for a conditional use permit to <br />construct an accessory structure for a principal strUcture classified as a legal, non-conforming <br />use. City Code requires a .conditional use permit to add square footage to the legal, non- <br />conl-brming use at 9537 Highway 10. <br /> <br />The following items are enclosed for your information: <br /> <br />a) site location map <br />b) site plan <br />c) Zoning administration letter dated December 27, 1991 <br />d) Proposed Findings of Fact <br />e) Proposed Conditional Use Permit <br /> <br />Notification: <br /> <br />State statute requires notification of the public hearing to property owners within 350 feet of the <br />subject property. Staff sp/nt out notices to all property owners within 350 feet. <br /> <br />Observations: <br />The subject property is approximately 1 acre in size and is zoned B-2 Business District. The <br />proposal seeks to expand a legal, nonconforming use by constructing a garage, as an accessory <br />use to a private residence located on the property. The residence was established as a legal, <br />nonconlbrming use by the City of Ramsey in 1991, as outlined in the zoning administration letter <br />dated. December 27, 1991. Because of this designation, the property requires a conditional use <br />permit to allow an accessory structure to be constructed. <br /> <br />The applicant seeks to construct a 24x32 foot, detached garage on the n°rthw~st comer of the <br />property that conforms to all setbacks. The proposed building will be constructed with 8 foot <br />sidewalls and three thermal paned windows. The siding is proposed to match the color 'and <br />materials of the recently updated house. The garage will be primarily used for vehicle and <br />personal storage. <br /> <br />Recommendation: <br /> <br />S taft recommends granting the request for the conditional use permit/ <br />Commission Action: <br /> <br />23 <br /> <br /> <br />
