Councilmember XXXXX introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #XXXXX <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT <br />TO ALLOW THE CONSTRUCTION OF AN ACCESSORY STRUCTURE FOR A <br />LEGAL, NONCON'FOR2¥IING RESIDENCE FOR THE PROPERTY LOCATED AT 9537 <br />HIGHWAY 10 BASED ON FINDINGS OF FACT #XXX AND DECLARING TERMS OF <br />SAME: <br /> <br /> WHEREAS, George and Frances Cowles (Permittee) have properly applied for a <br />conditional use permit to construct an accessory structure for a legal, nonconforming use for the <br />property located within the Metropolitan Urban Service Area (MUSA) established in section <br />9.03.14 of City. Code on the property generally known as 9537 Highway 10 and legally described <br />as follows: <br /> <br />Lot 2, Block I, Cowles Addition <br />(Subject Property) <br /> <br /> WHEREAS, the Planning Commission met on September 1, 2005 conducted the <br />public hearing and recommended City Council approval of the request. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br /> ? <br />Based on Findings o~' Fact #XXX, a conditional use permit (Permit) is hereby granted to <br />George and Frances Cowles, hereinafter referred to as the "Permittee" <br /> <br />That this permit shall allow the Permittee the right to construct a 768 square foot garage as an <br />accessory use to the legal, nonconforming residence on the subject property. <br /> <br />That the construction of the detached accessory building on the Subject Property shall require <br />issuance of a building permit from the City of Ramsey. <br /> <br />That the accessory building shall be properly constructed and maintained in accordance with <br />all applicable Uniform Building Codes and local Zoning regulations. <br /> <br />The Pe~rnittees herein agree that no business or residential use will be operated in the <br />detached accessory building unless such use is permitted in accordance with the City Code. <br /> <br />That this Permit shall be perpetual in duration as long as the terms are herein complied with. <br /> <br />That the Permittee shall be responsible for ali City costs incurred in administering and <br />enforcing this Permit. <br /> <br />That the City Administrator, or his/her designee, shall have the right to inspect the premises <br />for compliance and safety purposes annually or at any time, upon reasonable request. <br /> <br /> <br />
