CASE <br /> <br /> PUBLIC HEARING <br /> REQUEST FOR AN AMENDED CONDITIONAL USE PERMIT FOR <br /> GREEN VALLEY GREENHOUSE; CASE OF JOHN ROWE <br /> By: Asst. Community Development Director Sylvia Frolik <br /> <br />Background: <br /> <br />Green Valley Greenhouse was in operation as a lawful non-conforming use from 1977 to 1990. <br />[n 1990, the City Council issued a Conditional Use Permit for an expansion of the greenhouse <br />~hcility. That permit was amended again in 2000 and 2004 for expansion plans. The 2004 <br />amendment process looked at a 6 year growth plan for the business and an 'ultimate <br />devek~pment area' was established in accordance with the City's standard 35% building <br />coverage restriction. <br /> <br />Mr. Rowe is requesting another amendment to the ConditiOnal Use Permit to allow for the sale. <br />o1' bulk landscape materials on the property. <br /> <br />Notilication: <br /> <br />State Statues require notification of public hearings to owners of property within 350 feet of the <br />subject property. City Staff attempted to notify owners of property within 700feet of the Subject <br />Property. <br /> <br />Observations: <br /> <br />In 2005, Green Valley Greenhouse also began stocking and selling bulk landscape materials. <br />City Stall' notified Mr. Rowe that the addition of a sales area to expand the facility to now <br />include sale of bulk landscape materials is not covered under the current Conditional Use Permit. <br />Mr. Rowe had two options: a) cease the sales of bulk landscape materials; b) obtain an <br />amendment to the Conditional Use Permit to allow for additional' product sales. Consequently, <br />Mr. Rowe did apply for an amended Conditional Use Permit. <br /> <br />Mr. Rowe is proposing that the maximum area devoted to the sale of bulk landscape materials <br />would be 30~ x 145'. The products to be offered for sale include crushed rock, wood mUlch, and <br />soil. The product is and would continue to be stored outside in bins. <br /> <br />As with all land use applications, all City dePartments were made aware of the request. The Fire <br />Department noted that they have been working with Mr. Rowe to implement a plan that would <br />providc [br better fire apparatus access throughout the operation. The greenhouses are placed <br />quite densely and emergency access is vital for public safety. Staff determined that it would be <br />appropriate to address this issue in the amended Conditional Use Permit, if it is approved. <br /> <br /> <br />
