Assistant Public Works Director Olson responded in the affirmative. <br /> <br />Mayor Gamec stated due to the comments the City has received the access should remain shut <br />off. <br /> <br />Public Works Director Kapler requested the Council to consider when the water utility is stubbed <br />that a hydrant be installed on the developer side of the property line. Whether that road goes <br />through or not the City utility line ending in a hydrant would be a huge benefit strictly for <br />emergencies. It would be beneficial as a stopgap alternative to putting the street through and <br />there is a good possibility the residents would save on their homeowners insurance. <br /> <br />The consensus of the Council was to include an additional condition that a hydrant be installed <br />on the developer side of the property line when the water utility is stubbed. <br /> <br />Mayor Gamec inquired if the hydrant would be at the developer expense or City expense. <br /> <br />Assistant Public Works Director Olson replied staff would ask that the water be stubbed to the <br />property line; he does not think there would be a concern about cost if the water is stubbed on the <br />developer side of the property line with a request that it be stubbed with a hydrant. <br /> <br />Councilmember Strommen inquired about the status of the developer obtaining a Certificate of <br />Completion from the MPCA in relation to the lead issue. <br /> <br />Ms. Frolik replied this is included as a condition of the preliminary plat. <br /> <br />Motion by Councilmember Cook, seconded by Councilmember Jeffrey, to approve the <br />preliminary plat for Sweet Bay Ridge with the following conditions: <br /> <br />a. Compliance with City Staff Review Letter dated August 2, 2005 <br />b. Resolution of trail alignment with City Staff and DNR <br />c. Obtaining a variance or making the necessary adjustments to front yard setback <br /> requirements on certain lots prior to applying for final plat approval <br />d. Obtaining a Certificate of Completion from MPCA for site clean-up prior to applying <br /> for final plat approval <br />e. A hydrant will be installed on the developer side of the property line when the water <br /> utility is stubbed. <br /> <br />Further discussion: Assistant Public Works Director Olson noted there is a case later in the <br />agenda relative to the utility extension. The Staff Review Letter states that approval is <br />contingent on municipal sewer and water being extended to this area. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Cook, Jeffrey, Olson, Pearson, <br />and Strommen. Voting No: None.
