Regular Planning Commission 7.5. <br />Meeting Date: 01/27/2022 <br />Submitted For: Bria Raines, Community Development <br />By: Bria Raines, Community Development <br />Information <br />Title: <br />PUBLIC HEARING: Consider Ordinance 422-08 Amending City Code Section 117-51 Regarding Conditional Use <br />Permits <br />Purpose/Background: <br />The purpose of this case is to revise the conditional use permit (CUP) process to only require meeting with the <br />Planning Commission. The process is modeled after the City's variance procedures. The existing procedure for a <br />conditional use permit requires a public hearing at the Planning Commission, where a recommendation is made, <br />and the case is then brought to City Council, where the request is approved with potential conditions or denied. <br />The proposed revision would require one public hearing with the Planning Commission; at which time, the request <br />will be approved (with potential conditions) or denied. <br />This revision comes from feedback at a City Council work session in 2021. <br />Notification: <br />Notification was provided in the City's Official Newspaper, the Anoka County UnionHerald. <br />Observations/Alternatives: <br />Alternative 1: Approve Ordinance 422-08 as prepared. <br />Alternative 2: Approve Ordinance 422-08 with revision of two meetings with Planning Commission; the first <br />meeting a public hearing, and the second for a motion to adopt or deny. <br />Alternative 3: Deny Ordinance 422-08. <br />Funding Source: <br />Staff is handling this case as part of regular duties. <br />Recommendation: <br />Staff recommends adoption of Ordinance 422-08. <br />Action: <br />Motion to recommend the City Council introduce Ordinance 422-08 Amending City Code Chapter 117-51 <br />regarding conditional use permits <br />Attachments <br />Revision to Section 117-51 (Full) <br />Ordinance 422-08 <br />
