WIIEREAS, no expenditure of CITY funds will be made until the City Code escrow requirements have been completed by the DEVELOPER; and WItEREAS, City Code Section 9.50.50 defines "Stage I" Improvements and "Stage II" hnprovcmcnts which respective definitions are used herein when reference is made to "Stage I" and "Stage II" hnprovements. NOW, THEREFORE, the CITY and DEVELOPER agree as follows: SECTION I STAGE I IMPROVEMENTS AND FINANCIAL GUARANTEES City Code Compliance. The CITY approves the Plat conditioned on the DEVELOPER developing the Plat in accordance with the applicable provisions of City Code, Section 9.50, entitled Subdivision. Conformance with Plan. The Plat shall be developed pursuant to the final plat for Sun~]ower Ridge 2® Addition, consisting ofi°~n~'i"~h~e~ prepared by passe Engineering. Incorporation of All City Code Requirements. That the recitals above and the applicable provisions of' the City Charter, Subdivision Code, Zoning Code and Public Improvement Code of the CITY, as amended to date hereof, are incorporated herein by reference. Stage I hnprovemei~ts. Stage I Improvements shall consist of sanitary sewer, municipal water, and storm sewer. The installation of these Improvements shall be established as a term of thc Development Permit entered into with the CITY for the development of the property subsequent to obtaining site plan approval from the City Council. Stage I Improvements Required. The improvements the City requires the DEVELOPERS to construct within the Plat are as follows: g. h. i. Public street, curb and gutter Trunk and lateral sanitary sewer system Trunk and lateral watermains and appurtenances Trunk and lateral storm drainage facilities Lot grading and permanent erosion control Temporary and permanent erosion control facilities Natural gas Telephone service Electric service ("Stage I Improvements") Sunflower Ridge 2"~ Addition Development Agreement Page 2 of 8
