CASE # ADOPT AMENDMENT TO ORDINANCE FOR SEWER AND WATER TRUNK CHARGE HOOK-UP R~TE FOR ~SEY TOWN CENTER 2~D ADDITION By: James E. No.:r.man~ City Administrator Bacl¢~]'ound: Thc Rmnsey Town Center (RTC) entered i~to -an .option a~eement approximately two years ago with I).R. lqorton, a major housing: developer, to const~ct approximately 60 acres of the t'c~idcntial development, amounting to.approximately 900 dwelling units, in the Town Center (map attached). Rccently, negotiations ~ave 'been unde~ay to create an amendment to the option agreement that would redace the role of D.R. Hollon to a 12-acre parcel in the Town Center, also known as Ramsey'Towh Cefiter:2~. Addition. Limiting the role of D.R. Hot, on would allow for more housing development vadew and allow more building projects to happen concurrently rather than on a consecutive~'BaSi~ as proposed by D.R. Ho~on. Staff has been suppo ~'Iive of the negotiations be~een the RTC and D.R. Ho~on. The allocation agreement for the RTC.2na Addition allows the developer to pay for the sewer and water trunk hook-up charges at the time of the building permits rather than the usual method of paying flmm at the time of final plat. That being the case, the building permit fees have not been initiated and the sewer and watei' trunk hd...ok-up charges have not been paid. In order for the optiol~ ~tgreement between RTC and D.R. :Herren to be completed, D.R. Herren has requested that thc 103 residential units in RTC 2na Addition be able to use 2004 sewer and water trunk hoolc-up Fees. Staff' believes that allowing 2004 sewer and water trunk hook-up fees is a small price to pay for a better residential develoPment in Ihe TownlCenter and recommended Council authorize the rates i.o complete the option agreement at.the Council meeting of January 11, 2005. Staff further recommended that future allocation agreem, ehts d° not allow for sewer and water trunk hook-up fccs to be det~l'red at time of final plat. Si~aee:sewer and water hook-up fees are adopted during the annual rates, fees and charges ordinance, the-City Attorney advised that the action required amendment to the annual rates, fees andchhrges ordinance. The ordinance was introduced at the January l 1~h meeting and is now ready for Council adoption consideration. Council Action: Motion to adopt Ordinance #05-'XX to colle0t .Sewer and water trunk hook-up charges at the 2004 rate scheduled for the Ramsey Town ;Center 2nd addition and direct staff that ali future sewer and water trunk hook-up charges are collested at time of final plat.
