Ie asked if Traprock has a Homeowner's Association. <br /> <br />Mr. t lamburg stated they are in the process of developing one. He indicated they have covenants <br />on their property now. <br /> <br />Commissim~er Johnson indicated there are some possibilities for restricting the land that could be <br />pursued. <br /> <br />Mr. I.lamburg stated he would want that in place before this development was approved. <br /> <br />Commissioner Johnson stated that the agreement would have to be between Traprock Commons <br />and thc City, so the negotiations should be with the City. <br /> <br />Motion by Commissioner Johnson, seconded by Chairperson Nixt to close the public hearing at <br />9:03 p.m. <br /> <br />Motion carried. Voting Yes: Chairperson Nixt, Commissioners Johnson, Levine, Shepherd, and <br />Van Scoy. Voting No: None. Absent: Commissioners Brauer and Watson. <br /> <br />Commission Business <br /> <br />Chairperson Nixt asked how Staff felt about the trail proposed, noting that he believes it to be <br />reasonable. <br /> <br />Assistant Community Development Director Frolik stated that this will go to the Park <br />('om mission again, and there have been several changes made over the last couple of days. <br /> <br />Commissioner Johnson stated that he would be opposed to the trail going behind homes on the <br />east, and he thinks the sidewalk connection would work fine. <br /> <br />Chairperson Nixt stated that the City has a wetland preservation ordinance that he has been <br />opposed to, and they are seeing voluntary preservation here. He asked what would have been <br />required under thc ordinance if it had been in effect at this time. <br /> <br />Mr. t~assc indicated that he is not entirely sure, noting there are three classes of wetlands, but <br />lhcy arc not classified yet. He stated the DNR wetland is adjacent, and they kept those areas <br />deeper. [lc reviewed the various wetland areas and the conservation easement depth proposed at <br />each. <br /> <br />(~.ommissioner Johnson suggested that the City try to provide some assurance to the neighbors in <br />Traprock Co,mnons.
