Assistant Community Development Director Frolik advised that Staff recommends approval of <br />thc request to renew the Conditional Use Permit for an asphalt plant. <br /> <br />Public llcaring <br /> <br />Chairperson Nixt opened the public hearing at 9:48 p.m. <br /> <br />(:hairperson Nixt asked if the applicant was required to make the site improvements because this <br />is a new permit, and not a renewal. <br /> <br />Assistant Community Development Director Frolik stated the improvements are voluntary, but <br />thc Planning Commission could make them conditions of the new permit. <br /> <br />Commissioner Van Scoy asked if the applicant has been cooperative, and Assistant Community <br />l)cvclopmcnt Director Frolik indicated that they are always cooperative. <br /> <br />Motion by Chairperson Nixt, seconded by Commissioner Johnson to close the public hearing at <br />9:50 p.m. <br /> <br />Motion carried. Voting Yes: Chairperson Nixt, Commissioners Johnson, Levine, Shepherd, and <br />Van Scoy. Voting No: None. Absent: Commissioners Brauer and Watson. <br /> <br />Commission Business <br /> <br />Motion by Chairperson Nixt, seconded by Commissioner Johnson to recommend City Council <br />adopt Findings of Fact favorable to the applicant relating to Commercial Asphalt's request for a <br />conditional use permit for a hot mix asphalt plant. <br /> <br />Motion carried. Voting Yes: Chairperson Nixt, Commissioners Johnson, Levine, Shepherd, and <br />Van Scoy. Voting No: None. Absent: Commissioners Brauer and Watson. <br /> <br />Motion by Chairperson Nixt, seconded by Commissioner Johnson to recommend City Council <br />approve thc request for a conditional use permit from Commercial Asphalt, based on the findings <br />o1' fact, and adopt Resolution declaring terms of same. <br /> <br />Motion carried. Voting Yes: Chairperson Nixt, Commissioners Johnson, Levine, Shepherd, and <br />Van Scoy. Voting No: None.
