FC Case

RESIDENTIAL CURBSIDE RECYCLING CONTRACT
BY: James E. Norman, City Administrator
Chris Anderson, Zoning & Recycling Coordinator

Background:

In January of 2002, the City entered into a three (3) year contract with ACE Solid Waste,
Inc. I'm' the curbside collection of residential recycling. The contract included an option
/bt a one (1) year extension which was exercised for 2005. The current contract with
ACI:, Solid Waste, Inc. is set to expire on December 31, 2005.

The fi}ilowing items are enclosed for your review:

al) I,ctter fi:om Mike Berkopec of ACE Solid Waste, Inc.
b) A( ',1:, Solid Waste, Inc. proposal for recycling services

Observations:

It has generally been the City's past practice to solicit proposals for the residential
curbsidc recycling service. However, recycling is a contracted service rather than the
purchase of "supplies, materials, equipment, or rental, thereof, or the construction,
alteration, repair, or maintenance of real or personal property". Therefore, State Statute
docs not require the City to obtain competitive bids.

A(iI.; Solid Waste, Inc. has expressed a desire to continue providing recycling services for
thc City of' Ramsey. Mike Berkopec, with ACE Solid Waste, has submitted a letter to the
City outlining ACE's desire to continue to service the City of Ramsey as well as a
proposal tbr a single sort collection program.

As you know, the City's current recycling program functions as a two-sort program,
meaning that paper products must be separated from recyclable containers (plastic, steel,
tin, aluminum, and glass). Some haulers are now converting to a single sort system,
which requires no separation of recyclables by residents. The single sort system has
shown to increase participation in recycling by residents as well as increase the overall
tonnage collected.

Recommendation:

Thc l:inance Committee may want to consider entering into contract negotiations with
ACt,~ Solid Waste or direct Staff to obtain quotes from recycling haulers licensed to
(~pcratc in thc City. The quoting process would enable the City to verify that it is
receiving competitive and comparable prices to other cities in the area. The City does
have at its discretion the ability to award a contract to a company that meets the best
interests of thc City, rather than awarding the contract based solely on the lowest bid
price. Il' the Finance Committee is so inclined to direct Staff to enter into negotiations
