Normal high-water mark means a continuous mark of reference at an elevation where land and water meet
<br />for some period of record; is commonly that point where the natural vegetation changes from predominantly
<br />aquatic to predominantly terrestrial.
<br />Notice of intent (NOI) means a written notice to the Minnesota Pollution Control Agency that the city plans
<br />on meeting the MS4 permit requirements.
<br />NPDES means National Pollutant Discharge Elimination System (NPDES) as established pursuant to 33 USC
<br />1342(b) to regulate discharges of Pollutants to the waters of the United States.
<br />NPDES permit means an NPDES stormwater discharge permit that is issued by the Minnesota Pollution
<br />Control Agency (MPCA) to regulate discharges of pollutants to waters of the United States, whether the permit is
<br />applicable to an individual, group or general area -wide basis.
<br />Nuisance or public nuisance. See chapter 10, Animals, for specific definition.
<br />Nursing home, rest home or convalescent home means a building having accommodations where care is
<br />provided for two or more invalids, infirmed, aged, convalescent, or physically disabled persons that are not of the
<br />immediate family; but not including hospitals, clinics, sanitariums or similar institutions.
<br />Obstruction means any dam, wall, wharf, embankment, levee, dike, pile, abutment, projection, excavation,
<br />channel modification, culvert, building, wire, fence, stockpile, refuse, fill, structure, or matter in, along, across, or
<br />projecting into any channel, watercourse, or regulatory floodplain which may impede, retard, or change the
<br />direction of the flow of water, either in itself or by catching or collecting debris carried by such water.
<br />Official map means a map adopted in accordance with the ordinance from which this chapter is derived
<br />showing existing streets, proposed future streets and the area needed for widening of existing streets of the city.
<br />An official map may also show the location of existing and future land and facilities within the city. An official map
<br />may cover the entire city or any portion of the city.
<br />Off-street loading space means a space accessible from the street, alley or way, in a building or on the lot for
<br />the use of trucks while loading or unloading merchandise or materials. Such space shall be of such size as to
<br />accommodate one truck of the type typically used in the particular business and shall be exclusive of general public
<br />and employee parking spaces.
<br />On site means any location within the boundaries of a site.
<br />One hundred -year floodplain means lands inundated by the regional flood.
<br />Opacity means the degree to which a structure, use or view is screened from adjacent properties.
<br />Open sales lot means any open land used or occupied for the purpose of buying, selling and/or renting
<br />merchandise and for the storing of same prior to sale.
<br />Open space means an area set aside for the preservation of natural open spaces to counteract the effects of
<br />urban congestion and monotony.
<br />Open space recreation uses means recreation use particularly oriented to and utilizing the outdoor character
<br />of any area; including hiking and riding trails, primitive campsites, campgrounds, waysides, parks and recreational
<br />areas.
<br />Operable motor vehicle means a vehicle that can be presented in a self-propelled condition within seven days
<br />of the city's request for such action.
<br />Operator means any person, any partnership, limited partnership or corporation, or any association of
<br />persons, engaged in surface mining operations and issued a permit therefor pursuant to this Code or the pilot of an
<br />aircraft.
<br />Ordinary high-water mark means either of the following:
