Councilmember introduced the following resolution and moved for its adoption: <br />RESOLUTION #22-008 <br />A RESOLUTION APPROVING DEVELOPMENT <br />AGREEMENT FOR RIVERSTONE SOUTH <br />RECITALS <br />1. Capstone Homes dba Riverstone Development, LLC hereinafter referred to as the <br />"Permittee" has an approved preliminary plat and associated Final Plat for Riverstone <br />South for the property legally described in Exhibit A (the "Subject Property"). <br />2. That a contingency of approval for the Final Plat for Riverstone South included the <br />Permittee entering into a Development Agreement with the City. <br />3. That the City Council reviewed and approved the Development Agreement on January 25, <br />2022. <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />That the Ramsey City Council hereby grants approval of the Development Agreement (the <br />"Agreement") for Riverstone South on the Subject Property contingent upon the following <br />conditions: <br />CONDITIONS <br />1. Final legal form approved by the City Attorney. <br />2. That the Permittee shall be responsible for all City costs incurred in administering and <br />enforcing this Permit. <br />3. Review and approval by City Engineer and City Finance Department. <br />4. Approved Final Plat and associated contingencies. <br />5. The Applicant entering into a maintenance agreement for necessary outlots (e.g. <br />stormwater ponds) and execution of said agreements. The City authorizes the use of the <br />standard template agreement for said agreements, contingent upon City Attorney review. <br />6. Execution of the Pearson's Assessment Agreement for Riverdale Drive shall be recorded <br />concurrently with Development Agreement and/or Riverstone South Final Plat. <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />, and upon vote being taken thereon, the following voted in favor <br />thereof: <br />
