filling to create a buffer strip shall not be required. All other roadways and trails shall meet the <br />buffer standards established in this Section. <br /> <br /> Subd. 4. Development Grading. Although it is the intent of this section that any <br />existing wetland buffer be maintained within the designated buffer width for the wetland <br />management classifications, some disruption may be necessary for developmental grading. If the <br />slope subsequent to final grading is greater than twelve (12) percent, then the maximum buffer <br />width for the wetland type is applicable. The use of a meandering buffer strip is encouraged to <br />help maintain a natural characteristic but average buffer widths must be adhered to. The widest <br />portion of the buffer should be in natural runoff areas. Construction grading should be kept <br />mindful of the natural runoff areas and graded appropriately. <br /> <br /> Subd. 5. Voluntary Buffer Creation. Wetland buffer strips not required by this <br />Section may be voluntarily created in conformance with the requirements of this Section <br />concurrent with approval of a site plan, or in the absence of a site plan, upon approval of an <br />administrative permit. <br /> <br /> Subd. 6. Wetland Buffer Widths and Setbacks. Wetland Buffer widths and <br />setbacks for the various Wetland Management Classifications are as shown on the <br />following table: <br /> <br />Management Classification Preserve Manage 1 Manage 2 Manage 3 <br />Wetland Buffer Strip Min. Structure Setback from Buffer Strip** 15' 15' 15' 15' <br /> <br />* Buffer widths in excess of the listed maximums shall not be used in calculating the average <br />buffer width. <br /> <br />** These setbacks shall take precedence over other setbacks required in this Chapter. <br /> <br />9.26.07 Alternative Wetland Buffer Strips with Extraordinary Management <br />Measures. <br /> <br /> Subd. 1. Variance Requirements. A variance will be required to install and/or <br />maintain a narrower wetland buffer strip than required by this section. The variance shall be <br />processed in accordance with the procedures established in Section 9.03.07 of Chapter 9. <br />Criteria governing consideration of a variance request to reduce the minimum wetland buffer <br />strip width requirements shall include, but not be limited, to the following: <br /> <br />Whether the variance will have the effect of allowing a use that is <br />prohibited in the applicable zoning district. <br /> <br />-22- <br /> <br /> <br />
