There have been some
differences of opinion as to whether this rule applies to all projects or only those that receive federal funding. To protect
the cities from being sued, I would recommend that it put the truncated domes on their rights of ways as part of any
project.

7here also has been some discussion as to whether cities mUst require private parties to put in truncated domes on the
private sidewalks. This may depend upon your local ordinances. Attached is an article from the League of Minnesota
Cities magazine on this issue that also provides links to the rules related to this.

if any of yOLI have dealt with this issue, please let me know.

F!len Longfellow
LMCIT Loss Control Attorney
(651) 281 - 1269
ek}ngfei~lmr~c.or~

You are currently subscribed to city-eng as: unknown lmsubst tag argument:"
'i'o unsubscribc send a blank email to leave-city-eng-7950U~listserv.lmnc.org

T¼is email has been scanned by the MessageLabs Email Security System.
For more inl'ormation please visit http://www.messagelabs.com/email

15

9/t 6/20O5
