Board Member Johnson introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #05-07-197 <br /> <br />RESOLUTION ADOPTING FINDINGS OF FACT #0724 RELATING TO A REQUEST <br />FOR A VARIANCE TO REAR YARD SETBACK REQUIREMENTS <br /> <br /> WHEREAS, Panther Precision Machine, Inc., hereinafter referred to as "Applicant," has <br />properly applied for a variance from Section 9.20.24 of the Ramsey City Code to construct an <br />addition to the existing building that will encroach on the rear yard setback on the property <br />generally known as 6640 Sunwood Drive and legally described as follows: <br /> <br />[Jot 3, Block 1, Sunfish Business Park, Anoka County, Minnesota. <br /> <br />NOW TItEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the Board of Adjustment conducted a public hearing pursuant to Section 9.03.07 of the <br />Ramsey City Code on July 7, 2005, and that said public hearing was properly advertised, and that <br />thc lninutcs of said public hearing are hereby incorporated as a part of these findings by <br />rc~rence. <br /> <br />l. ~l'hat the subject property is zoned E-1 Employment District and is approximately 2.55 <br /> acres in size. <br /> <br />2. That the subject property is surrounded by E-1 Employment District zoning developed <br /> with businesses. <br /> <br />3. That section 9.20.24 (E-1 Employment District) requires a thirty-five (35) foot rear yard <br /> setback. <br /> <br />That the applicant is proposing to enlarge an existing building that will have an <br />encroachment of 7.4 feet on the southwest side and an encroachment of 4.57 feet on the <br />southeast side. <br /> <br />5. That the lot is irregular shaped, narrower in the north and wider in the south, with the <br /> existing building set parallel to the west side yard setback. <br /> <br />That the lot can accommodate the 15,000 square foot addition, but to remain consistent <br />with the existing building design, 718 square feet of the addition will encroach on the rear <br />yard setback (7.4 feet on the southwest side and 4.57 feet on the southeast side). <br /> <br />7. That the variance requested is the minimum variance, which would alleviate the hardship. <br /> <br />8. That if granted, the variance will not permit a use that is prohibited in the E-1 <br /> l';mployment District. <br /> <br /> <br />
