Board Member Johnson introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #05-08-246 <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0733 RELATING TO A <br />REQUEST FOIl A VARIANCE TO THE IMPERVIOUS SURFACE RESTRICTIONS IN <br />TIlE WIIA) AND SCENIC RIVER OVERLAY DISTRICT TO ACCOMMODATE AN <br />O IrTI)OOR DINING PATIO AND ADDITIONAL CUSTOMER PARKING <br /> <br /> WItEREAS, Suntide Commercial Realty, Inc, the owner of the River's Bend Plaza <br />kmatcd at 14001 St. Francis Blvd NW, hereinafter referred to as "Applicant", has properly <br />appliecl fi)r a Board of Adjustment variance from the impervious surface restrictions in the Wild <br />and Scenic River Overlay District on the property legally described as follows: <br /> <br />Lot 2, Block I, River's Bend Plaza, Anoka County, Minnesota <br /> <br />(thc "Subject Property") <br /> <br /> NOW TItEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT <br />TIlE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />q'hat the Applicant appeared before the Board of Adjustment for a public hearing <br />pursuant to Section 9.03.07 of the Ramsey City Code on August 8, 2005, and that said <br />public hearing was properly advertised and that the minutes of said public hearing are <br />hereby incorporated as a part of these findings by reference. <br /> <br />'l'hat the subject property is zoned PUD Planned Unit Development and is approximately <br />3.3 acres in size. <br /> <br />q'hat tile properties to the north and south are zoned PUD Planned Unit Development, the <br />properties to the west (across St. Francis Blvd) are zoned B-1 Business District, and the <br />property to the east is zoned R-3 High Density Residential. <br /> <br />4. That tile subject property is the site of a multi-tenant building. <br /> <br />'l'hat the northern end unit has a turfed area adjacent to it that had been utilized as a play <br />area for a previous tenant of the building. <br /> <br />'l'hat the Applicant is proposing to convert this turfed area into an outdoor dining patio <br />and additional customer parking for Tanners Tavern and Grill, a prospective tenant. <br /> <br />7. That thc Subject Property is located in the Wild and Scenic River Overlay District. <br /> <br />That Section 9.23.06(1) (Scenic River Overlay District Development Standards) <br />establishes the maximum impervious surface area allowed as 30% of the total lot area. <br /> <br /> <br />
