(ihairpcrson Nixt introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #05-08-248 <br /> <br />I/ESOLUTION ADOPTING FINDINGS OF FACT t/0734 RELATING TO A REQUEST <br />FOR A VARIANCE TO SIDE YARD SETBACK REQUIREMENTS <br /> <br /> WHEREAS, Sharp & Associates, LLC, hereinafter referred to as "Applicant," has <br />properly applied for a variance from Section 9.20.24 of the Ramsey City Code to construct a <br />building that will encroach on the side yard setback on the property generally known as 6431 <br />14(}~h Court and legally described as follows: <br /> <br />Lot 4, Block 1, Sunfish Gateway Business Park, Anoka County, Minnesota. <br /> <br />NOW TIIEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CTFY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />q'hat thc Board of Adjustment conducted a public hearing pursuant to Section 9.03.07 of the <br />R. amscy City Code on August 8, 2005, and that said public hearing was properly advertised, and <br />that the minutes of said public hearing are hereby incorporated as a part of these findings by <br />reference. <br /> <br />1. That the subject property is zoned E-1 Employment District and is approximately 39,356 <br /> square feet or 0.9 acres in size. <br /> <br />2. q'hat the subject property is surrounded by E-1 Employment District zoning developed <br /> with businesses. <br /> <br />3. That section 9.20.24 (E-1 Employment District) requires a twenty (20) foot side yard <br /> setback. <br /> <br />4. q'hat thc subject property was 1.3 acres in size during the Preliminary Plat Review for <br /> Sunfish Gateway at the Planning Commission on June 6, 2002. <br /> <br />5. q'hat the Preliminary Sunfish Gateway Plat was to be accessed by a private street off <br /> Sunfish Lake Boulevard. <br /> <br />6. 'l'hat the City Council approved the plat on June 25, 2002, contingent upon the private <br /> strcct be dedicated as a public street on the plat. <br /> <br />7. 'l'hat the dedication of public street easement reduced the proposed lot size of the subject <br /> property from 1.3 acres to 39,356 square feet or 0.9 acres in size. <br /> <br /> <br />
