Councilmember introduced the following resolution and moved for its adoption: <br /> RESOLUTION #22-036 <br /> RESOLUTION GRANTING FINAL PLAT APPROVAL OF RICES RUM RIVER ACRES <br /> WHEREAS, Mark Rice, hereafter referred to as "Applicant", properly applied for Sketch Plan <br /> and Final Plat approval of the following described property located in the City of Ramsey: <br /> Lots 11 and 12, Block 6, Barthel's Rum River Acres 2nd Addition,Anoka County, Minnesota <br /> Or upon platting: <br /> Lot 1, Block 1, Rices Rum River Acres, Anoka County, Minnesota <br /> (the `Subject Property'); and <br /> WHEREAS, the Applicant is proposing a future accessory structure that would encroach into <br /> the Scenic Easement on the Subject Property; and <br /> WHEREAS, on February 22, 2022, the City Council introduced Ordinance #22-13 vacating <br /> drainage and utility easements on the Subject Property; and <br /> WHEREAS, on February 22, 2022, the City Council reviewed the location of a proposed <br /> detached accessory structure and the Final Plat of Rices Rum River Acres. <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br /> RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> 1) That the Ramsey City Council hereby grants final plat approval of Rices Rum River Acres in <br /> accordance with relevant City Codes, subject to the following conditions: <br /> a) Approval by the City Engineer; and <br /> b) Final Plat subject to review and approval as to legal form by the City Attorney; and <br /> c) Adoption of Ordinance 22-13 vacating all existing drainage and utility easements on the Subject <br /> Property (note that drainage and utility easements are rededicated with the Final Plat); and <br /> d) Approval of a Variance to the OHW setback requirement. <br /> 2) That the Ramsey City Council hereby authorizes the construction of a detached accessory building <br /> partially within the Scenic Easement on the Subject Property as shown in the attached Exhibit. <br /> The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br /> , and upon vote being taken thereon, the following voted in favor thereof: <br /> and the following voted against the same: <br /> and the following abstained: <br />
