CC Regular Session 7. 4. <br /> Meeting Date: 02/22/2022 <br /> Submitted For: Brian McCann, Community Development <br /> By: Bria Raines, Community Development <br /> Information <br /> Title: <br /> Adopt Ordinance#22-06 Amending City Code Chapter 117, Sections 1 and 351 Regarding Home Occupations <br /> Purpose/Background: <br /> Ordinance#22-06 (formerly#21-20)Amending City Code Chapter 117, Sections 1 and 351 Regarding Home <br /> Occupations. The revised sections regarding Home Occupations will address all business types conducted on a <br /> residential property. <br /> This change is very minor and more administrative in nature. <br /> Meetings <br /> •November 18, 2021: A public hearing was held at the Planning Commission. Planning Commission members <br /> approved motion to introduce ordinance to City Council. <br /> •December 14, 2021: Staff presented ordinance to City Council work session for feedback prior to <br /> introduction. <br /> •January 11, 2022: Ordinance was presented to City Council at regular session for introduction. Council <br /> requested revisions to proposed Ordinance and item to be brought to January 25,2022 City Council work <br /> session. <br /> •January 25, 2022: Staff revised Ordinance based on Council input and presented revisions at City Council <br /> work session meeting. <br /> •February 8, 2022: Staff presented Ordinance#22-06 to City Council for introduction. <br /> Based on feedback from Council, Staff has made the following recent revisions: <br /> •The zoning administrator definition has been revised to include the fire marshal, chief of police, and any <br /> other designee. <br /> •Commercial vehicles, shown in the table, are subject to the off-street parking codes. Meaning that more than <br /> one signed vehicle is allowed, in accordance with section 117-355. <br /> •Home occupation permit holders shall be given reasonable notice if an inspection is requested. The <br /> inspection would include the area covered by the permit. Ex. a home occupation limited to an accessory <br /> structure,would not require an inspection of the principle structure. <br /> •The language for the death or move of a home occupation permit holder has been revised. The section has <br /> been separated,the death and desired continuous by the surviving family shall continued with written notice <br /> to the zoning administrator, subject to the same original terms. <br /> • Should the occupation move to a new location,the permit may request the city council to authorize the <br /> occupation in the new location. This provides the opportunity for Staff and Council to ensure that the <br /> occupation will be harmonious with the proposed neighborhood,not cause disturbances, and allow <br /> public comment from the properties that would be near to the home occupation in the new <br /> neighborhood. <br /> Notification: <br />
