Councilmember introduced the following resolution and moved for its adoption: RESOLUTION#22-055 RESOLUTION RESCINDING AND REPLACING RESOLUTION #22-008 APPROVING DEVELOPMENT AGREEMENT FOR RIVERSTONE SOUTH RECITALS 1. Capstone Homes dba Riverstone Development, LLC hereinafter referred to as the "Permittee" has an approved preliminary plat and associated Final Plat for Riverstone South for the property legally described in Exhibit A (the "Subject Property"). 2. That a contingency of approval for the Final Plat for Riverstone South included the Permittee entering into a Development Agreement with the City. 3. That the City Council reviewed and approved the Development Agreement on January 25, 2022. NOW THEREFORE,BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITYOF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1) That the Ramsey City Council hereby grants approval of the Development Agreement(the "Agreement") for Riverstone South on the Subject Property contingent upon the following conditions: CONDITIONS 1. Final legal form approved by the City Attorney. 2. That the Permittee shall be responsible for all City costs incurred in administering and enforcing this Permit. 3. Review and approval by City Engineer and City Finance Department. 4. Approved Final Plat and associated contingencies. 5. The Applicant entering into a maintenance agreement for necessary outlots (e.g. stormwater ponds) and execution of said agreements. The City authorizes the use of the standard template agreement for said agreements, contingent upon City Attorney review. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember , and upon vote being taken thereon, the following voted in favor thereof: and the following voted against the same: and the following abstained: and the following were absent:
