COUNCIL BUSINESS <br /> 7.01: Adopt Resolution#22-037 Supporting Housing and Local Decision-Making Authority <br /> This item was moved to Consent Agenda Item 5.07. <br /> 7.02: Adopt Ordinance#22-03 Amending Chapter 10 of City Code: Animals <br /> Deputy City Administrator/ Community Dev. Director Hagen stated this ordinance is before the <br /> Council for adoption. He stated it was last seen by the Council on January 11, 2022 when it was <br /> introduced. Staff has not received any additional questions or comments on the ordinance since <br /> then. <br /> Councilmember Musgrove referenced Section 7 on the Miscellaneous Maintenance Standards, <br /> Point E. She stated it reads "no animal of any type may be maintained on any parcel within the <br /> City,no matter what size the parcel, if the maintenance of said animal creates a nuisance as defined <br /> in Chapter 30." She stated when she went to Chapter 30,under nuisances, it talks a lot about noise <br /> but not noise from animals. She noted the noise section has decibels and times and asked for more <br /> clarification on the hours for noise which are from 10 p.m. to 7 a.m. under the nuisance chapter. <br /> She also asked how the City could enforce that timewise if animals are making noise. <br /> Deputy City Administrator/ Community Dev. Director Hagen replied that it reads "if the <br /> maintenance of said animal creates a nuisance as defined in Chapter 30" and he supposed that <br /> could be related to blight conditions on the property. He wasn't sure that it was intended to address <br /> noises that animals naturally make which can't be controlled.
