Councihnember XXXXXXXXXXXX introduced the following resolution and moved for its adoption: RESOLUTION #05-09- A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT TO EXCEED ACCESSORY BUILDING SQUARE FOOTAGE RESTRICTIONS AT 7960 171''t LANE NW BASED ON FINDINGS OF FACT AND DECLARING TERMS OF SAME: WHEREAS, David and Lynette Randall (Permittee) have properly applied for a conditional use permit to exceed the detached accessory building square footage restrictions established in section 9.11.02 "Accessory Uses" of City Code on the property generally known as 7960 171~t Lane NW and legally described as follows: [Jot 3, Block 1, Dellwood Hills, Anoka County, Minnesota (Subject Property) WHEREAS, the Planning Commission met on September 1st, 2005, conducted the public hearing and recommended City Council approval of the request. NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 3. Based on Findings of Fact #0__, a Conditional Use Permit (Permit) to exceed the detached accessory building square footage restriction for said property as established in City Code, is hereby granted to David and Lynette Randall, hereinafter referred to as the "Permittee" That the new accessory building shall not exceed 1,200 square feet and the total accessory building space on the subject property shall not exceed 2,480 square feet. That the construction of the detached accessory building on the Subject Property shall require issuance of a building permit from the City of Ramsey. That the accessory building shall be properly constructed and maintained in accordance with all applicable Uniform Building Codes and local zoning regulations. 'l'hat the Permittee herein agrees that no business use will be operated in the detached accessory building unless such use is permitted in accordance with the City Code. That this Permit shall be perpetual in duration as long as the terms are herein complied with. That the Permittee shall be responsible for all City costs incurred in administering and en fi)ming this Permit.
