Councilmember XXXXX introduced the following resolution and moved for its adoption: RESOLUTION #05-09- A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT TO ALLOW THE CONSTRUCTION OF AN'ACCESSORY STRUCTURE FOR A LEGAL, NON-CONFORMING RESIDENCE ON THE PROPERTY LOCATED AT 9537 HIGHWAY #10 N.W., BASED ON FINDINGS OF FACT #0__ AND DECLARING TERMS OF SAME. WHEREAS, George and Frances Cowles (Permittee) have properly applied for a Conditional Use Permit to construct an accessory structure for a legal, non-conforming residence oa the property generally known as 9537 Highway # 10 N.W. and legally described as follows: I~ot 2, Block 1, Cowles Addition, Anoka County, Minnesota (Subject Property) WHEREAS, the Planning Commission met on September 1, 2005, conducted the public hearing and recommended City Council approval of the request. NOW THEREFORE, BE IT RESOLVED BY THIS CITY' COUNCIL OF THE CITY (IF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: Based on Findings of Fact #0 ., a Conditional Use Permit (Permit) is hereby granted to George and Frances Cowles, hereinafter referred to as the "Permittee" That this permit shall allow the Permittee the right to'construct a 768 square foot garage as an accessory use to the legal, non-conforming residence on the Subject Property. That the construction of the detached accessory building on the Subject Property shall require issuance of a building permit from the City of Ramsey. That the accessory building shall be properly constructed and maintained in accordance with all applicable Uniform Building Codes and local zoning regulations. The Permittee herein agree that no business use will be operated in the detached accessory building unless such use is permitted in accordanCe .with the City Code. That this Permit shall be perpetual in duration as long as the terms are herein complied with. That the Permittee shall be responsible for all City costs incurred in administering and enfbrcing this Permit. That tim City Administrator, or his/her designee, shall have the right to inspect the premises lbr compliance and safety purposes annually or at any time, upon reasonable request. Thai: this Permit shall automatically expire if the use is not initiated by September 27, 2006, and issuance of the building permit shall constitute initiation.
