CASE <br /> <br />REQUEST FOR AN AMENDED CONDITIONAL USE PERMIT FOR <br />GREEN VALLEY GREENHOUSE; CASE OF JOHN ROWE <br /> By: Asst. Community Development Director Sylvia Frolik <br /> <br />Background: <br /> <br />Green Valley Greenhouse was in operation as a lawful non-conforming use from 1977 to 1990. <br />[n 1990, the City Council issued a Conditional Use Permit for an expansion of the greenhouse <br />l'hcility. That permit was amended again in 2000 and 2004 for expansion plans. The 2004 <br />amendment process looked at a 6 year growth plan for the business and an 'ultimate <br />development area' was established in accordance with the City's standard 35% building <br />coverage restriction. <br /> <br />N~tification: <br /> <br />State Statues require notification of public hearings to owners of property within 350 feet of the <br />subject property. City Staff attempted to notify owners of property within 700feet of the.Subject <br />Property or' the September 1 public hearing conducted by the Planning Commission. <br /> <br />Observations: <br /> <br />In 2005, Green Valley Greenhouse also began stockpiling and selling bulk landscape materials. <br />City Staff notified Mr. Rowe that although the area selected for the sale of bulk landscape <br />materials complied with the ultimate business growth area established in 2004, the permit did not <br />anticipate or address stockpiling and selling materials not grown or produced on the site. Mr. <br />Rowe had two options: a) cease the sales of bulk landscape materials; b) obtain an amendment <br />to the Conditional Use Permit to allow for additional product sales. Consequently, Mr. Rowe did <br />apply for an amended Conditional Use Permit. <br /> <br />Mr. Rowe is proposing that the maximum area devoted to the sale of bulk landscape materials <br />would be 30' x 145' The products to be offered for sale include crushed rock, wood mulch, and <br />soil. The product is and would continue to be stored outside in bins. <br /> <br />As with all land use applications, all City departments were made aware of the request. The Fire <br />Department noted that they have been working with Mr. Rowe to implement a plan that would <br />provide lbr better fire apparatus access throughout the operation. The greenhouses are placed <br />quite densely and' emergency access is vital for public safety. Staff determined that it would be <br />appropriate to address this issue in the amended Conditional Use Permit~ if it is approved. <br /> <br />The Planning Commission conducted a public hearing on September 1 and no written or verbal <br />comments were submitted to the Commission. <br /> <br /> <br />
