Absent: Commissioners Johnson and Levine. <br /> <br />NOTING OF CITY COUNCIL MINUTES <br /> <br />I) City Council regular meeting minutes dated July 26, 2005 <br />2) City Council regular meeting minutes dated August 9, 2005 <br />The City Council minutes were noted. <br /> <br />PUBLIC HEARINGS/COMMISSION BUSINESS <br /> <br />Case#1.: Use Permit for Green Valley <br /> <br />Request for an-Amended Conditional <br />Greenhouse; Case of John Rowe <br /> <br />Presentation - <br /> <br />Assistant Community Developmem Director Frclik stated that Gte. eh Valley.Greenhouse was in <br />operation as a lawful non-conforming use from 197'7 to 1990. She indlcated, tllat i~ 1990, the <br />City Council issued a Conditional Use Permit for an expansion of the greenhouse facility. She <br />si atcd that that permit was amended again in 2000 and' 2004 for expansion plans,. She indkated <br />that thc 2004 amendment process looked at a six year growJh plan for the'-..business and an <br />'ttltimate development area' was established. '' <br /> <br />Assistant Community Development Director Frolik dtated that in 2005, Green Valley Greenhouse <br />also began stocking and selling bulk landscape materials, such as soil, gravel, and rock.· She <br />indicated that City Staff notified Mr. Rowe that the addition ora sales, ama..to.expand:·the facility <br />to now include sale of bulk landscape materials is not covered under the current Conditional Use <br />Permit. She indicated that consequently, Mr. Rowe did apply for an amended Conditional Use <br />Permit. <br /> <br />Chairperson Nixt clarified that the nursery has a conditional use permit, and there is nothing in <br />the City's Ordinance that defines a nursery, but Staff feels this is inconsistent with what a nursery <br />should be. Chairperson Nixt noted that he does not see a restriction on {his kind of use in the <br />terms o I~ the conditional use permit. <br /> <br />Assistant Community Development Director Frolik stated that Staff feels it is inconsistent with <br />the 6 year business plan established in the Conditional Use Permit amendment of 2004. That <br />plan addressed expansion of the offices, warehouse, and nurseries for additional growing area. <br />The plan addressed the needs of the nursery as it relates to growing their inventory; it did not <br />address importing landscape materials to be sold from the property. <br /> <br />Planning Commission/September 1, 2005 <br /> Page 2 of 19 <br /> <br /> <br />
